Part I - General Terms and Conditions

1 - Provider, inclusion of the GTC

(1) Ilka Detering, Sierichstr. 164, 22299 Hamburg, phone 015735130495, e-mail ilkajewels@gmail. com (hereinafter referred to as "Provider") is the provider and contractual partner for the goods shown in the Etsy shop "ilkajewels".

(2) These general terms and conditions are part of every contractual agreement between the supplier and the respective customer. Any terms and conditions of the customer to the contrary are objected to.


2 - Offer of goods and conclusion of contract

(1) The supplier offers the articles shown in his Etsy shop "ilkajewels" for sale. The colour of the articles on the website may vary slightly depending on the Internet browser and monitor settings used by the customer; these deviations are technically unavoidable.

(2) The selection of goods, conclusion of the contract and processing of the contract shall be in German.

(3) The purchaser selects the desired goods by placing them in the "shopping basket". If all desired goods are contained there, the customer confirms this with the button "Proceed to checkout". The following page with the heading "Please confirm your order" shows the customer a summary of all his entries. The order request can be transmitted to the supplier on this page via the button "Pay now"; if the purchaser uses Klarna's service ("Immediately") for payment, the order request is transmitted to the supplier when the purchaser clicks the button "Next" on the "Confirm transaction" page. Until the order has been sent, the customer has the option of correcting his entries at any time by going back one or more order steps in the browser or cancelling the order completely.

(4) The supplier makes a binding purchase offer for the items displayed in his shop. By sending the order request via the "Pay now" button, the customer accepts the purchase offer. The provider confirms the conclusion of the contract by e-mail (contract confirmation).

(5) The content of a concluded contract (contract text) is automatically stored by Etsy in the Etsy user accounts of the provider and the purchaser and can be viewed by the purchaser in his user account under "Purchases and ratings" in the "You" menu. After conclusion of the contract, Etsy will additionally send the customer an e-mail with the text of the contract. Furthermore, the provider does not store the contract text and does not make it accessible outside the Etsy portal.

(6) In the event of obstacles to delivery or other circumstances which would prevent performance of the contract, the Supplier shall inform the Purchaser by e-mail.


3 - Prices and payment

(1) All product prices are total prices plus shipping costs. The fees include the statutory value added tax.

(2) The shipping costs are listed in the respective product description in the "Shipping & Returns" section.

(3) The customer can pay by credit card (VISA, MasterCard, American Express). The shopping cart may also contain other payment methods, e. g. PayPal or Klarna ("Immediately. ").

(4) Payments by the Purchaser may be accepted on behalf of the Supplier of Etsy Ireland UC, 66/67 Great Strand Street, Dublin 1, Ireland, or, if paid in US dollars or Canadian dollars, by Etsy Inc. , 117 Adams Street, Brooklyn, NY, USA, (hereinafter referred to as "Etsy"). In this case Etsy forwards the paid amount to the provider.

(5) The Supplier retains title to the delivered goods until the Customer has paid the purchase price in full.

(6) For deliveries to countries outside the European Union, customs duties and import sales tax may be payable by the customer on receipt of the consignment to the customs authorities. These charges are in addition to the purchase price and shipping costs and cannot be influenced by the provider.

4 - Right of revocation

(1) A customer who buys as a consumer is entitled to a right of revocation in accordance with the legal conditions.

(2) A consumer is any natural person who concludes a legal transaction for purposes which can predominantly neither be attributed to his commercial nor to his self-employed professional activity.

(3) The provider also grants a right of withdrawal to a consumer with permanent residence outside Germany in accordance with the above paragraphs if the national law of the consumer does not provide for a right of withdrawal or if the withdrawal is linked to a shorter period or a stricter form than regulated here.

5 - Warranty (liability for defects)

The customer has warranty claims (also referred to as warranty rights for defects) in accordance with the statutory provisions.


6 - Extrajudicial settlement of disputes

(1) The EU Commission provides an online platform at ec. europa. eu/consumers/odr (OS platform) for the out-of-court settlement of disputes arising from a distance contract with a consumer.

(2) The supplier is neither obliged nor prepared to participate in out-of-court consumer dispute resolution proceedings.

7 - Final provisions

(1) The law of the Federal Republic of Germany shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods. However, German law shall not apply to consumers who are permanently resident abroad to the extent that the national law of the consumer contains provisions which cannot be deviated from by contract at the expense of the consumer.

(2) Should individual provisions of these General Terms and Conditions prove to be invalid or impracticable, this shall not affect the validity of the remaining provisions.

Part II: Information on the consumer's right of withdrawal

You have the right to revoke this contract within fourteen days without giving reasons. The time limit for revocation is fourteen days from the day on which you or a third party appointed by you who is not the carrier took or has taken possession of the goods.

To exercise your right of withdrawal, you must inform us (Ilka Detering, Sierichstr. 164, 22299 Hamburg, phone 015735130495, e-mail ilkajewels@gmail. com) by means of a clear declaration (e. g. a letter, fax or e-mail sent by post) of your decision to withdraw from this contract. You can use the attached model withdrawal form, but this is not mandatory.

In order to comply with the revocation period, it is sufficient that you send the notice of the exercise of the revocation right before the expiry of the revocation period.

Consequences of the revocation

If you cancel this Agreement, we will refund all payments we have received from you, including delivery costs (except for the additional costs resulting from your choosing a delivery method other than the cheapest standard delivery offered by us), immediately and at the latest within 14 days from the day we receive notice of your cancellation of this Agreement. We will use the same means of payment for this refund as you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees for this refund.

We may refuse to refund until we have received the goods back or until you can prove that you have returned the goods, whichever is earlier.

You must return or hand over the goods to us immediately and in any case at the latest within fourteen days from the day on which you inform us of the revocation of this contract. The deadline is met if you dispatch the goods before the expiry of the fourteen-day deadline.

You bear the direct costs of returning the goods.

They shall only be liable for any loss in value of the goods if such loss in value is due to handling of the goods which is not necessary for checking the nature, properties and functioning of the goods.

Exceptions to the right of withdrawal

The right of withdrawal does not apply to contracts for the delivery of goods which are not prefabricated and for the manufacture of which an individual choice or destination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.
