General Terms and Conditions of the Etsy Shop "Natalia Artesania"

§ 1
Provider, inclusion of the GTC and defence clause

The operator of the shop and contractual partner for the goods presented in the Etsy shop "Natalia Artesania" is: Natalia Schadler, Glusavinastrasse 16, 6773 Vandans (hereinafter referred to as "Provider").

These general business services are part of every contractual agreement between the provider and the respective customer and come into force at the time of the order. Deviating terms and conditions of the customer will be rejected.

§2
Offer of goods and conclusion of contract

Natalía Artesanía is managed as a small business according to § 19 UStG. Therefore, VAT is neither levied nor shown.

The provider offers items presented in his Etsy shop "Natalía Artesanía" for sale. The colour representation of the articles on the website may vary slightly depending on the Internet browser used and the monitor settings of the customer; these deviations are never technically completely avoidable.

Goods selection, conclusion of contract and contract processing are carried out in German or in English.

By confirming the button "Order with obligation to pay" in the ordering process of the Etsy shop "Natalía Artesanía", the customer makes a binding offer to conclude a contract with the provider. The provider confirms the conclusion of the contract by e-mail (contract confirmation).

In the event of impediments to delivery or other circumstances that would conflict with the fulfilment of the contract, the provider shall inform the customer by e-mail. A tail delivery takes place only with the consent of the customer.

§3
Ownership

The delivered goods remain the property of the provider until full payment has been made.

§4
Prices and payment

The shipping costs are listed for the respective product under the item "Shipping costs".

For deliveries to Switzerland and other countries outside the EU, customs duties and import sales tax may be incurred, which must be paid by the customer to the customs authority upon receipt of the shipment. This information is in addition to the purchase price and the shipping costs and is not to be influenced by the provider.

The provider delivers at the choice of the customer against advance payment by bank transfer or against advance payment by PayPal payment.

For prepayment orders, a payment period of 7 working days from receipt of the contract confirmation applies. The supplier shall return the desired goods for the duration of the payment periods for the customer. It is the customer's responsibility to effect his payment in time for it to be received by the provider within the deadline. The provider reserves the right to withdraw from the purchase contract and sell the goods elsewhere if payment has not been received by the deadline. Any payment received by the customer after withdrawal will be refunded to the customer.

When ordering ceramic objects or custom-made products of the like, the goods can also be paid for in cash upon collection from the provider.

§ 5
Shipping and Delivery

The provider delivers within Austria as well as within the EU and worldwide.
The nationwide delivery takes place, depending on the payment method, on weekdays within 1-3 days after full receipt of money. However, this does not apply to custom-made products.
Delivery dates or periods are always non-binding, unless expressly agreed otherwise.

The shipping company needs about 2 working days within Austria for delivery from handover by the provider and - depending on the distance - up to 9 working days to other countries.
If the delivery to the customer fails because the customer has entered the delivery address incorrectly or incompletely, a new delivery attempt will only be made if the customer assumes the costs for the new shipping. The renewed shipping costs correspond to the shipping costs agreed at the time of conclusion of the contract. The provider will inform the customer of the necessary costs of a new delivery by e-mail. A new shipment will only take place after receipt of payment of these costs.
If the buyer wishes to pay for the goods in cash, he can pick them up at the registered office of the provider by appointment within 5 working days (only applies to ceramic objects and custom-made products of the like).

§ 6
Warranty

The warranty rights of the customer are based on the general legal regulations.
A guarantee is not declared by the provider.



§ 7
Liability

7.1. The following exclusions and limitations of liability shall apply to the Seller's liability for damages, without prejudice to the other statutory requirements for entitlement.
7.2. The seller is liable without limitation if the cause of the damage is based on intent or gross negligence.
7.3. Furthermore, the Seller shall be liable for the slightly negligent breach of essential obligations, the breach of which endangers the achievement of the purpose of the contract, or for the breach of obligations the fulfilment of which makes the proper execution of the contract possible in the first place and on the observance of which the Customer regularly relies. In this case, however, the seller is only liable for the foreseeable, contract-typical damage. The seller is not liable for the slightly negligent violation of obligations other than those mentioned in the preceding sentences.
7.4. The above limitations of liability do not apply in the event of injury to life, body and health, for a defect after the assumption of a guarantee for the quality of the product and in the case of fraudulently concealed defects. Liability under the Product Liability Act remains unaffected.
9.5. Insofar as the seller's liability is excluded or limited, this also applies to the personal liability of employees, representatives and vicarious agents.

§ 8
Privacy

The seller processes personal data of the customer for a specific purpose and in accordance with the legal provisions of the GDPR (see data protection).
