Terms & Conditions
§1 field of application
These terms and conditions apply to the production, sale and supply of goods by Magic Tribal Hair to the customer and no other terms shall apply. Magic Tribal Hair reserves the right at its sole discretion to amend these terms and conditions at any time.
§2 Order/ payment
Magic Tribal Hair will deliver the goods ordered after the arrival of your payment.Your order may contain items offered in the Magic Tribal Hair, Gothic Hair Dreams or Steampunk Hair Dreams online shop or custom- made products (order must be confirmed by Magic Tribal Hair first!). Especially items containing kanekalon hair are custom- made products, because you are always free to choose the hair colours I will blend for your hairfalls/ switch braid etc... After you have made your choice, via e-mail or telephone, you will receive an e-mail confirming your offer and telling exact delivery time and an invoice as attachment. Production is started only after your payment has come in, which means that Magic Tribal Hair only delivers on advance payment.
European customers from outside Germany: The invoice also contains the domicile of the payment with BIC/ SWIFT and IBAN codes, so that you will not be charged more for EU-wide money transfers as for those within your bank's country, if you use these codes correctly for SEPA money transfer in Euro. If you live in a non-Euro country your bank may charge you for the conversion, please ask your bank about these costs. You can also pay through Paypal, which does not cause any costs for you.
YOU WILL RECEIVE A RECEIPT VIA E-MAIL AFTER THE PAYMENT HAS COME IN.
Non- European and Swiss customers (USA, Australia, Canada etc.): You will receive an invoice via e-mail including my e-mail address for PAYPAL money transfer, so there won't be any costs for you for money-transfer. Payments to my bank account are not possible. YOU WILL RECEIVE A RECEIPT VIA E-MAIL AFTER THE PAYMENT HAS COME IN.
CUSTOMS DUTIES AND IMPORT SALES TAX:
Deliveries to some European countries (e. g. Switzerland) may cause customs duties and/ or import sales tax (the sales tax percentage in your country), which must be paid by the customer. Deliveries are often free up to a certain value; Magic Tribal Hair adds form CN 22 and a copy of the invoice to every delivery into custom-affected countries, so you can't be charged too much. Please inform about customs duties and import sales taxes at your local tax office.
§3 Minimum order value

§4 Contract formation/ cancellation right
The contract is valid as soon as you have received the invoice. You are asked to pay within 7 workdays (Monday to Friday). If your payment comes in later, the date of delivery might change. Magic Tribal Hair is also allowed to cancel your order if your payment has not come in within 7 days. It is recommended to inform Magic Tribal Hair if the payment cannnot be done by that time for any reasons.
Your cancellation right: You may cancel your order within 14 days, starting with the date of the invoice. This has to be done in writing by letter or e-mail. Please send your cancellation to:

An order may be cancelled without any problems before the money transfer. Magic Tribal Hair has the right to claim damages in the case of cancellation, when your payment has already been confirmed, because then material is orderd or production is started. This agreement is also valid in case the 14 days have not run out yet. So if your payment is confirmed 5 days after the date of the invoice, the cancellation right has not terminated, but Magic Tribal Hair has the right to claim damages for the work which has been done so far or for material bought for your order..Unfortunately it is impossible to put things differently for orders of hand- and custom- made products.
For the same reasons Magic Tribal Hair will not accept refunds without claiming for damages. Many products are only produced to order and in many cases according to your wishes, so they are custom- made items. Moreover it is not suitable to refund for hair jewelry and hairfalls for hygienic reasons.
Naturally, Magic Tribal Hair will refund wrong deliveries or defects in material, of course.
§5 Time of delivery
Time of delivery is determined by the volume of your order, because all items are hand- made, so production times can differ extremely. Feel free to ask for a certain date or period of delivery.
Please notice that most Magic Tribal Hair items are made to order.
Deliveries time can only be carried out punctually if payment is made in time. Delay in payment might naturally cause delay in delivery.
§6 Terms of shipment and shipping costs
Shipping costs include postal charges and boxing and are paid by the customer.
Orders of 30,00 € or more are always shipped with insurance.
The customer has to ensure that he or she has posted right the address for shipping. If an order has to be sent twice, because Magic Tribal Hair were given the wrong address, this has to be paid by the customer him- or herself.
§7 Prices
All prices are final prices/ gross prices. German VAT/ sales tax of 19 % applies. As I sell shipping to you, I also have to charge taxes for shipping costs.
§8 Choice of law and jurisdiction
German law is applicable for all Magic Tribal Hair transactions and the place of jurisdiction is Cologne.
Other
The validity of the contract is not affected, if parts of these conditions should not be effective in law or should lose their validity later on. In this case the two parties will find a suitable valid provision. The same matter applies if the contract should contain an unforeseeable gap.
