General Terms and Conditions and Customer Information / Privacy Policy

General Terms and Conditions

§ 1 Basic provisions
The following terms and conditions apply to all contracts that you conclude with us as a provider (Jasmin Peters) via the etsy Internet platform. Unless otherwise agreed, the inclusion of any of your own terms and conditions used by you will be objected to.
(2) A consumer within the meaning of the following regulations is any natural person who concludes a legal transaction for purposes that can predominantly be attributed neither to their commercial nor their independent professional activity. An entrepreneur is any natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of his independent professional or commercial activity.

§ 2 Conclusion of the contract
(1) The object of the contract is the sale of goods.
(2) If an article is posted by us at etsy, the activation of the offer page at etsy constitutes the binding offer to conclude a purchase contract under the conditions contained in the article page.
(3) The goods intended for purchase are stored in the "shopping cart". Via the corresponding button in the navigation bar you can call up the "shopping cart" and make changes there at any time. After calling up the order form, the personal data as well as the payment and shipping conditions are entered. Before sending the order, you have the option of checking all information again, changing it (also via the "back" function of the Internet browser) or cancelling the purchase. By sending the order via the button "order with obligation to pay", the purchase contract is binding.
(4) The processing of the order and transmission of all information required in connection with the conclusion of the contract is partly automated by e-mail. You must therefore ensure that the e-mail address you have stored with us is correct, that the receipt of the e-mails is technically ensured and, in particular, that spam filters do not prevent it.

§ 3 Right of retention, retention of title
(1) You can only exercise a right of retention if it concerns claims from the same contractual relationship.
(2) The goods remain our property until full payment of the purchase price.

§ 4 Liability
(1) We shall be liable without restriction for damages resulting from injury to life, limb or health, in all cases of intent and gross negligence, in the event of fraudulent concealment of a defect, in the event of assumption of the guarantee for the quality of the object of purchase, in the case of damage under the Product Liability Act and in all other cases regulated by law.
(2) Insofar as essential contractual obligations are affected, our liability for slight negligence is limited to the contractually typical, foreseeable damage. Essential contractual obligations are essential obligations arising from the nature of the contract and the violation of which would jeopardize the achievement of the purpose of the contract as well as obligations that the contract imposes on us according to its content in order to achieve the purpose of the contract, the fulfillment of which makes the proper execution of the contract possible in the first place and on the observance of which you may regularly rely.
(3) In the event of a breach of insignificant contractual obligations, liability for slightly negligent
Breaches of duty excluded.
(4) According to the current state of the art, data communication via the Internet cannot be guaranteed to be error-free and/or available at all times. In this respect, we are not liable for the constant or uninterrupted availability of the website and the service offered there.

§ 5 Choice of law, place of performance, place of jurisdiction
(1) German law shall apply. In the case of consumers, this choice of law shall only apply insofar as this does not withdraw the protection afforded by mandatory provisions of the law of the state of the consumer's habitual residence (principle of favourability).
(2) Place of performance for all services arising from the existing business relationships with us as well as
The place of jurisdiction is our registered office, insofar as you are not a consumer, but a merchant, a legal entity under public law or a special fund under public law. The same applies if you do not have a general place of jurisdiction in Germany or the EU or if the domicile or habitual residence is not known at the time the action is brought. The right to appeal to the court at another statutory place of jurisdiction remains unaffected by this.
(3) The provisions of the UN Convention on Contracts for the International Sale of Goods shall expressly not apply.

Additional policies and FAQs

Privacy policy

This Privacy Policy describes how and when I collect, use, and share information when you purchase an item from me, contact me, or otherwise use my services through Etsy.com or related websites and services.
This Privacy Policy does not apply to the practices of third parties that are not owned and controlled by me, including Etsy, or any third-party services you access through Etsy. To learn more about Etsy's privacy practices, see Etsy's Privacy Policy.

1. What information I collect

In order for me to process your order, you must provide me with certain information (for which you have authorized Etsy to provide it to me). This includes your name, email address, mailing address, payment information, and details of the product you order. You also have the option to provide me with further personal information (for example, for a custom-made jewellery) if you contact me directly.

2. Why I need your information and how I use it

I refer to a number of legal bases to collect, use and share your information. Specifically:

to the extent I need your information to provide my services, for example, to process your order, resolve disputes or provide customer support;
if you have given your express consent (which you can revoke at any time), for example by subscribing to my newsletter distribution list;
if it is necessary to comply with a legal obligation or court order, or in connection with legal claims, such as the need to retain information about your purchases due to tax legislation; and
to the extent necessary for the purposes of my legitimate interests – unless these legitimate interests are overridden by your rights or interests – such as 1. to provide and improve my services. I use your information to provide the services you have requested from me and in my legitimate interest to improve my services; and 2. to comply with Etsy's Seller Policy and Terms of Use. I use your information as necessary to fulfill my obligations under Etsy's Seller Policy and Terms of Use.

3. Disclosure and Disclosure of Information

Customer data is important to my business. I only disclose your personal data for certain reasons and in very specific circumstances, as follows:
Etsy: I share information with Etsy as needed to fulfill my obligations under Etsy's Seller Policy and Terms of Use.
Service Providers: I hire certain trusted third-party service providers to perform tasks and provide services for my store, such as parcel services. I pass on your personal data to these third parties, but only to the extent that it is necessary for the performance of these services.
Business Transfers: If I sell my business or merge with another, I may disclose your information as part of that transaction to the extent permitted by law.
Compliance with laws: I may collect, use, retain and disclose your information if I have a good faith belief that it is appropriate and necessary to: a) respond to legal process or regulatory requirements; b) enforce my contracts, terms and policies; c) prevent, investigate and remedy fraud and other illegal activities, security or technical problems or d) protect the rights, property and safety of my customers or other persons.

External payment service providers

I use external payment service providers through whose platforms users and we can make payment transactions. As part of the performance of contracts, I use the payment service providers on the basis of Art. 6 para. 1 lit.b. GDPR. The inventory data processed by the payment service providers includes, for example.B the name and address, bank data, such as.B. account numbers or credit card numbers, passwords, TANs and checksums as well as the contract, sums and recipient-related information. The information is required to carry out the transactions. However, the data entered will only be processed by the payment service providers and stored by them. This means that we do not receive any account or credit card-related information, but only information with confirmation or negative information of the payment. Under certain circumstances, the data may be transmitted by the payment service providers to credit agencies. The purpose of this transmission is to verify identity and creditworthiness. For this purpose, we refer to the terms and conditions and data protection information of the payment service providers.

For the payment transactions, the terms and conditions and the data protection information of the respective payment service providers apply, which can be called up within the respective websites or transaction applications. I also refer to these for the purpose of further information and assertion of rights of revocation, information and other data subjects.
