and Customer Information on Electronic Commerce

§ 1 Scope of Application
Orders via internet shall be governed by the following General Terms and Conditions as valid on placement of order.

§ 2 Conclusion of Contract
Webpage presentation of our goods shall be exclusively non binding to the ends to receive binding orders.
Customer by sending off his order shall give a binding contractual offer in the sense of § 145 BGB (German Civil Code). Customer will via electronic mail receive acknowledgement of receipt of his order. In case of any faulty presentation of goods on our webpage we in return will give separate notice to customer and make him offer to contract respectively.
Customer waives to receive a declaration of acceptance of contract in the sense of § 151 subparagraph 1 BGB (German Civil Code). Contract shall have been brought about by our acceptance of customer’s offer to contract which shall be either within ten days in writing or textual form or by our consignment of ordered goods or by customer’s advance payment. If advance payment is agreed on acceptance of contract shall be deemed to be declared on prepayment if within ten days after our dispatch of consignment.

§ 3 Obligation of Payment of Conventional Cost of Reshipment in Case of Lawful Cancellation
You shall carry conventional cost of reshipment if goods delivered are in accordance with order and price of goods to be reshipped no more than 40 € or, if more, you have not yet made counter-performance or contractual part payment. Otherwise reshipment shall be free of cost for you.

§ 4 Delivery/ Cost of Delivery/ Risk of Accidental Loss, Destruction or Deterioration
Cost of delivery shall be as identified for particular case. If customer is consumer we will carry risk of delivery no matter which kind of delivery. If customer is professional person he shall carry all risks of accidental loss, destruction or deterioration from the moment we have handed over consignment to our authorised freight agent.

§ 5 Reservation of Ownership
We shall retain ownership of goods delivered until complete payment of price has been effected.

§ 6 Payments
Ways of payment shall be limited to those notified to customer on his placement of order.

§ 7 Warranty
Warranty shall be subject to legal provisions under the BGB (German Civil Code). Legal Provisions under the HGB (German Code of Commerce) shall remain unaffected if under this law contract has status of commercial transaction for both parties.

§ 8 Consumer Information on Distance Contracts and Customer Information on Electronic Commerce
a) We shall not subscribe to any special and not previously indicated codes of conduct.
b) Before finally confirming and sending order you may find and correct any input errors via program’s delete and change options.
c) Please find relevant characteristics of our goods and limited validity of offers under specific product description on our webpage.
d) German shall be exclusive contractual language.
e) Complaints and claims based on warranty may be notified to the address given under provider’s identification.
f) Via pressing right mouse button of customer’s browser the text of contract may be saved on customer’s computer or may be printed via browser’s print option. Customer has no access to text of contract if ordering via our web shop. We will save text of contract in our data collection.
g) Please find information in respect of payment, delivery or completion of contract in offer to conclude contract.
h) If placing order via our web shop in due course you will be informed on options to find and correct input errors.


§ 9 Miscellaneous
a) Our and customer’s contractual relation and respective general terms and conditions shall be governed by the Laws of the Federal Republic of Germany. If customer has status of consumer his respective consumer rights under the laws of his country of residence shall remain unaffected by this agreement. Application of United Nation Sales Convention shall be excluded.
b) If customer has status of merchant under the provisions of HGB (German Commercial Code) or of public corporation our place of business shall be the exclusive place of jurisdiction. We are however, entitled to bring legal action forward at customer’s place of business.

§ 10 Severance Clause
In case of any provision of this contract in parts or in total being or subsequently becoming invalid the validity of rest of contract shall remain unaffected.

Datenschutzerklärung

(1) Nach einem Kaufvertragsschluss übermittelt Etsy dem Anbieter den Etsy-Nutzernamen, den Namen, die E-Mail und die Rechnungsanschrift, wie sie im Nutzerkonto des Bestellers hinterlegt sind. Soweit der Besteller im Rahmen seiner Bestellung weitere Daten angegeben hat (z.B. eine abweichende Lieferadresse oder eine Telefonnummer), werden auch diese übermittelt.

(2) Der Anbieter verarbeitet die in Absatz 1 genannten Daten elektronisch zur ordnungsgemäßen Vertragserfüllung, insbesondere für den Versand, die Rechnungsstellung und die Verbuchung von Zahlungen. Zum Zwecke des Versands kann der Anbieter Namen und Anschrift des Bestellers auch an das beauftragte Versandunternehmen übermitteln.

(3) Der Anbieter hält die Daten gespeichert, bis alle gegenseitigen Ansprüche aus der Bestellung vollständig erledigt und die handels- und steuerrechtlichen Aufbewahrungsfristen für den Anbieter abgelaufen sind.

(4) Der Besteller kann vom Anbieter jederzeit unentgeltlich Auskunft verlangen über die Daten, die er über den Besteller gespeichert hat. Ferner kann der Besteller jederzeit die Berichtigung fehlerhafter Daten verlangen.

(5) Für Daten, die der Anbieter gemäß obiger Absätze selbst verarbeitet, ist verantwortliche Stelle für den Datenschutz der Anbieter (BABY LAL®, Perihan Gülmez, Oranienstr. 12, 10999 Berlin, Tel.: +49 (30) 53 06 26 68, Email: info (@) baby-lal.de). Im Übrigen gilt ergänzend die Datenschutzerklärung von Etsy.

(6) Nutzt der Besteller für die Zahlung den Dienst von PayPal, gelten für den Zahlungsvorgang ergänzend die PayPal-Datenschutzbestimmungen. PayPal wird dabei als Erfüllungsgehilfe des Bestellers tätig, nicht des Anbieters.

(7) Nutzt der Besteller eine über Etsy Payments angebotene Zahlungsmethode, erhebt und verarbeitet Etsy Payments den Namen des Bestellers, seine Karten- oder Kontonummer und/oder weitere Daten, die für die gewählte Zahlungsmethode erforderlich sind. Es gelten insoweit ergänzend die Etsy Payments-Datenschutzbestimmungen.

(8) Unter einem Artikelfoto können Social-Media-Buttons eingeblendet sein; sie sind an den Logos der Social-Media-Plattformen (im folgenden "Plattformen") zu erkennen (Facebook: blaues "f", Google Plus: rotes "g+", Pinterest: rotes "p", Twitter: blaue Vogel-Silhouette). Es handelt sich dabei um Links zu den jeweiligen Plattformen mit Sitz in den USA. Ein Klick auf einen solchen Link ruft das Webangebot der jeweiligen Plattform auf, wobei die IP-Adresse des aufrufenden Endgeräts sowie die Adresse der Seite, von der aus verlinkt wird ("Referrer"), an die aufgerufene Plattform in die USA übermittelt werden. Vom Anbieter selbst werden im Zusammenhang mit den Social-Media-Buttons keine Daten erhoben, übermittelt oder sonst verarbeitet.
