General Terms and Conditions noni GmbH

1. Scope
1.1 These General Terms and Conditions (hereinafter referred to as "GTC") of NONI GmbH (hereinafter referred to as "Seller") apply to all contracts for the delivery of goods that a consumer or entrepreneur (hereinafter referred to as "Buyer") concludes with the Seller with regard to the goods offered by the Seller on the online trading platform Etsy (hereinafter referred to as "Etsy"). The inclusion of conflicting conditions of the buyer is contradicted.
1.2 A consumer within the meaning of the following regulations is any natural person who concludes a legal transaction for purposes that can predominantly be attributed neither to their commercial nor their independent professional activity. An entrepreneur is any natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of independent professional or commercial activity.
2. Conclusion of the contract
2.1 The object of the contract is the sale of bridal fashion. The contract is concluded exclusively in German. By listing an item on Etsy, the seller makes a binding offer to sell that item.
2.2 The Buyer may accept the Seller's offer via the online order form provided by Etsy. To do this, the buyer must first place the desired item in the virtual shopping cart at Etsy and then go through the order steps specified by Etsy. By clicking on the button that concludes the process, the buyer declares the acceptance of the offer, whereby a purchase contract for the items previously selected by the buyer is concluded.
2.3 Before sending the order, the buyer has the option of checking all information on the order overview page again, changing it (also via the "back" function of the Internet browser) or cancelling the purchase. By sending the order via the corresponding button, the buyer declares the acceptance of the offer in a legally binding manner, whereby the purchase contract is concluded.

2.4 The text of the contract will be stored by the seller and sent to the buyer after conclusion of the contract together with the present terms and conditions and buyer information in text form (e.B. e-mail or letter). A further access of the contract text by the seller himself does not take place.

3. Right of withdrawal
3.1 Consumers are generally entitled to a right of withdrawal. Further information on the right of withdrawal can be found in the seller's cancellation policy.
3.2 The right of withdrawal does not apply to consumers who are not members of a member state of the European Union at the time of conclusion of the contract and whose sole place of residence and delivery address at the time of conclusion of the contract are outside the European Union.

4. Terms of delivery and shipping
4.1 Unless otherwise agreed, the goods shall be delivered by dispatch to the delivery address specified by the buyer. When processing the purchase contract, only the delivery address specified in the order processing on the Etsy platform is decisive. Deviating from this, when selecting the payment method PayPal the delivery address deposited by the buyer at the time of payment at PayPal, shall be decisive.
4.2 If delivery to the Buyer at the specified address is not possible, the Buyer shall bear the costs for the unsuccessful shipment. 5. Terms of payment, prices
5.1 The prices quoted by the seller are total prices and include the statutory value added tax. Any additional delivery and shipping costs will be stated separately in the respective product description.
5.2 The payment option(s) will be communicated to the Buyer in the Seller's offer on Etsy.
5.3 In the case of deliveries to countries outside the EU, further costs may be incurred in individual cases, which are to be borne by the buyer. 6. Material defects

7. Retention of title, right of retention

4.1.4 Right to restriction of processing pursuant to Article 18 GDPR: You have the right to request the restriction of the processing of your personal data as long as the accuracy of your data disputed by you is verified, if you object to the deletion of your data due to inadmissible data processing and instead request the restriction of the processing of your data if you use your data to assert, exercise or defence of legal claims after we no longer need this data after the purpose has been achieved or if you have lodged an objection for reasons of your particular situation, as long as it is not yet clear whether our legitimate reasons prevail;
4.1.5 Right to information pursuant to Article 19 GDPR: If you have asserted the right to rectification, erasure or restriction of processing vis-à-vis the controller, the controller is obliged to inform all recipients to whom the personal data concerning you have been disclosed of this correction or deletion of the data or restriction of processing, unless this proves impossible or involves a disproportionate effort. You have the right to be informed about these recipients.
4.1.6 Right to data portability pursuant to Article 20 GDPR: You have the right to receive your personal data that you have provided to us in a structured, commonly used and machine-readable format or to request transmission to another controller, insofar as this is technically feasible;
4.1.7 Right to revoke granted consent in accordance with Article 7 (3) GDPR: You have the right to revoke your consent to the processing of data at any time with effect for the future. In the event of revocation, we will delete the affected data immediately, unless further processing can be based on a legal basis for processing without consent. The revocation of consent does not affect the lawfulness of the processing carried out on the basis of the consent until the revocation;

5. Duration of data storage
5.1 The duration of the storage of personal data is determined by the respective statutory retention period (e.B. commercial and tax retention periods).
5.2 After expiry of the period, the corresponding data will be deleted if they are no longer required for the fulfilment or execution of the contract or if there is no legitimate interest on our part in further storage.
