Part I - General Terms and Conditions

1 - Provider, inclusion of the GTC

(1) Provider and contractual partner for the goods shown in the Etsy shop "STINKSANDSTANKS" is Karsten Parey, Klosterbachstr 21, 18057 Rostock, phone 0381-21091417, e-mail contact@stinksandstanks. com (hereinafter referred to as "Provider").

(2) These general terms and conditions are part of every contractual agreement between the supplier and the respective customer. Any terms and conditions of the customer to the contrary are objected to.


2 - Offer of goods and conclusion of contract

(1) The supplier offers the articles shown in his Etsy-Shop "STINKSANDSTANKS" to other Etsy users for sale. The colour of the articles on the website may vary slightly depending on the Internet browser and monitor settings used by the customer; these deviations are technically unavoidable.

(2) The selection of goods, conclusion of the contract and processing of the contract shall be in German.

(3) The supplier delivers within Germany as well as to Austria, Switzerland, France, Italy and Spain.

(4) The purchaser selects the desired goods by placing them in the "shopping basket". In the "Check and order" step, the customer receives a summary for checking for input errors. The order request can finally be transmitted to the provider via the button "Payable order". Until the order has been sent, the customer has the option of correcting his entries at any time by going back one or more order steps in the browser or cancelling the order completely.

(5) The supplier makes a binding purchase offer for the goods displayed in the supplier's shop. By sending the order request via the button "Payable order" the customer accepts the purchase offer. The provider confirms the conclusion of the contract by e-mail (contract confirmation).

(6) The content of a concluded contract (contract text) is automatically stored by Etsy in the Etsy user accounts of the provider and the purchaser and can be viewed by the purchaser in his user account in the Etsy portal via the menu "My Etsy" under the item "My purchases". After conclusion of the contract, Etsy will additionally send the customer an e-mail with the text of the contract. Furthermore, the provider does not store the contract text and does not make it accessible outside the Etsy portal.

(7) In the event of obstacles to delivery or other circumstances which would prevent the fulfilment of the contract, the Supplier shall inform the Purchaser by e-mail.


3 - Prices and payment

(1) All product prices are total prices plus shipping costs. The fees include the statutory value added tax.

(2) The shipping costs are listed in the respective product description in the section "Payment & Shipping".

(3) In the case of deliveries to Switzerland, customs duties and import sales tax may be payable by the customer on receipt of the consignment to the customs authorities. These charges are in addition to the purchase price and the shipping costs and cannot be influenced by the provider.


(4) The offerer delivers after choice of the orderer against prepayment by redemption of an Etsy coupon, against prepayment by bank transfer or against prepayment by PayPal payment. With the confirmation of the contract the customer receives an Internet link by e-mail, which leads him to the Etsy area "My purchases", which contains further information on the purchase transaction.
(a) For payment via Etsy voucher, the customer can enter one or more voucher codes in the "My purchases" section. The voucher value is credited to the provider and the invoice amount is paid in this way. If a voucher value is higher than the invoice amount, the voucher remains valid in the amount of the excess amount.
(b) If the customer has chosen "bank transfer" as payment method, the customer will be informed of the provider's bank details in the "My purchases" section. Transfers from abroad are only accepted as free payments in Euro.
(c) If the customer has chosen "PayPal" as payment method, he can access the online service of PayPal via the "My purchases" section and can arrange payment there.

(5) If other payment methods are listed in the product description in the section "Payment and Shipping" (e. g. credit card, Sofortüberweisung, iDEAL, EPS), such payments will be processed via the payment service provider Mangopay S. A. , 59 Boulevard Royal, 2449 Luxembourg, www. mangopay. com).

(6) For advance payment orders, a payment period of 4 days from receipt of the contract confirmation applies. The Supplier shall return the desired goods to the Purchaser during the payment period. It is incumbent on the customer to effect his payment in time for it to be received by the supplier within this period. The supplier reserves the right to withdraw from the sales contract and to sell the goods elsewhere if payment has not been received by the end of the period. Any payment received from the customer after withdrawal will be refunded to the customer.


4 - Shipping, delivery periods

(1) The supplier delivers the goods within 3-5 working days after payment.

(2) For products marked as "customizable" in the product description, the delivery time increases by one week if the customer orders such individualization.

(3) For shipments to destinations outside Germany, the delivery time is increased by a further 9 working days.

(4) Several products ordered simultaneously shall be delivered in a common consignment; the delivery time of the product with the longest delivery time shall apply to the common consignment. If the customer requires the delivery of a certain product with a shorter delivery time in advance, he must order this product separately.

(5) If the delivery to the customer fails because the customer has given the delivery address incorrectly or incompletely, a new delivery attempt will only be made if the customer bears the direct costs of the new shipment. These costs correspond to the shipping costs agreed on conclusion of the contract.


5 - Consumer right of withdrawal

(1) A customer who buys as a consumer is entitled to a right of revocation in accordance with the legal conditions. A consumer is any natural person who concludes a legal transaction for purposes which can predominantly neither be attributed to his commercial nor to his self-employed professional activity.

(2) The provider grants a consumer with permanent residence outside Germany a consumer right of withdrawal in accordance with German requirements and legal consequences even if the national law of the consumer does not provide for a right of withdrawal or links the withdrawal to a shorter period or to a stricter form than under German law.


6 - Warranty (right of liability for defects)

The customer has warranty claims (also referred to as warranty rights for defects) in accordance with the statutory provisions.

7 - Final provisions

(1) The law of the Federal Republic of Germany shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods. However, German law shall not apply to consumers who are permanently resident abroad to the extent that the national law of the consumer contains provisions which cannot be deviated from by contract at the expense of the consumer.

(2) If the customer is a merchant, a legal entity under public law or a special fund under public law, the parties agree on the place of jurisdiction as the registered office of the provider.

(3) Should individual provisions of these General Terms and Conditions prove to be invalid or impracticable, this shall not affect the validity of the remaining provisions.


(2) Responsible person within the meaning of the EU Data Protection Ordinance (DSGVO) is the person natürliche or legal entity that alone or together with other über decides the purposes and means of processing personal data. The person responsible for personal data processed by the provider of this etsy shop is within the meaning of the DSGVO: Karsten Parey, Klosterbachstr 21, 18057 Rostock, phone 0381-21091417, e-mail contact@stinksandstanks. com (hereinafter "we"). In all other respects, the data protection declaration of Etsy GmbH also applies.


(3) If you conclude a contract with us via our Etsy shop, Etsy transmits your Etsy user name, your name and the billing address as they are stored in your Etsy user account. If you provide further data within the scope of your order (e. g. a different delivery address or a telephone number), these will also be transmitted to us.

(4) We process the data referred to in paragraph 3 electronically for the proper performance of the contract, in particular for delivery, invoicing, booking of payments and processing of returns and complaints. This data processing is carried out on the basis of Article 6(1)(b) DSGVO. We keep this data stored until all mutual claims arising from the respective contractual relationship with you have been completely settled and the commercial and tax retention periods to which we are subject have expired.

(5) For a contract between you and us it is necessary that we receive your name, your address and your Etsy user name. The necessity of providing this data arises among other things from Etsy's terms and conditions as well as from legal regulations (e. g. § 312i Abs. 1 Ziffer 3 BGB, § 14 Abs. 4 UStG). Without this data you cannot conclude a contract with us.

(6) If we send you physical goods on the basis of the sales contract, we transmit your name and your shipping address to Deutsche Post (Deutsche Post AG, 53113 Bonn) or DHL (DHL Paket GmbH, 53113 Bonn) as the shipping service provider, exclusively for the purpose of delivering the shipment to you on the basis of Article 6 paragraph 1 letter b DSGVO.

(7) If you use the PayPal service for payment, the PayPal Privacy Policy applies additionally to the payment process. PayPal will act on your behalf.

(8) If you use a payment method offered via Mangopay, Mangopay will collect and process on your behalf your name, card or account number and/or other data required for the payment method you have chosen. In this respect, the Mangopay data protection regulations also apply.

(10) If you send us a message via the function "Contact seller" on Etsy, Etsy sends us your Etsy user name together with your message (legal basis: Article 6 paragraph 1 letter a DSGVO). When you send us a message by e-mail, we store your message with the sender data (name, e-mail address) in order to answer it and also to be able to respond to any subsequent questions from you (legal basis: Article 6 paragraph 1 letter f DSGVO). For receiving, storing and sending e-mails we use an e-mail provider who acts for us as a processor in accordance with Article 28 DSGVO. We delete the data collected with your message no later than six months after the last communication with you regarding your request, subject to the regulations in the following paragraph.

(11) If you send us a legally relevant declaration on the contractual relationship (e. g. a revocation or a complaint), the legal basis for the processing, irrespective of the means of transmission, is also Article 6 paragraph 1 letter b DSGVO. In such a case, we will delete the data associated with your declaration as soon as all mutual claims from the contractual relationship have been finally settled and the commercial and tax retention periods have expired.

(12) Social media buttons may appear under an article photo; they can be recognised by the logos of the social media platforms (hereinafter "platforms") (Facebook: blue "f", Google Plus: red "g+", Pinterest: red "p", Twitter: blue bird silhouette). These are links to the respective platforms based in the USA. A click on such a link calls up the website of the respective platform, whereby the IP address of the calling terminal device and the address of the page from which the link is made ("referrer") are transmitted to the called platform in the USA. However, no data is collected or processed by us in connection with the social media buttons.

(13) We do without automated decision making and profiling.

(14) With regard to the personal data that we process about you, you have the following rights:
a) You have the right to ask us to confirm whether we are processing personal data concerning you. If this is the case, we will inform you of the personal data stored about you and the further information in accordance with Article 15 Paragraph 1 and 2 DSGVO.
b) You have the right to have incorrect personal data concerning you corrected without delay. Taking into account the purposes of the processing, you also have the right to request the completion of incomplete personal data - also by means of a supplementary declaration.
c) You can request the immediate deletion of your personal data under the conditions of Article 17 paragraph 1 DSGVO, as far as their processing is not required according to Article 17 paragraph 3 DSGVO.

d) You may request us to restrict the processing of your data if one of the conditions of Article 18 paragraph 1 DSGVO applies. In particular, you may request the restriction instead of deletion.
e) We will notify all recipients to whom we have disclosed personal data concerning you of any correction or deletion of your personal data and any restriction on processing, unless this proves impossible or involves disproportionate effort. We will also notify you of these recipients if you so request.
f) You have the right to receive the personal data you have provided to us in a structured, current and machine-readable format and may request that we transmit this data to another person responsible without hindrance, insofar as this is technically possible.
g) If data processing is based on your consent, you have the right to revoke your consent at any time. The revocation of the consent does not affect the legality of the data processing that has taken place until your revocation.


(15) RIGHT OF OBJECTION: FOR REASONS ARISING FROM THEIR PARTICULAR SITUATION, THEY MAY AT ANY TIME OBJECT TO THE PROCESSING OF PERSONAL DATA CONCERNING THEM; this right of objection exists with regard to data processing carried out on the basis of Article 6(1)(f) DSBER in order to protect the legitimate interests of us or a third party, unless your interests or fundamental rights and freedoms, which require the protection of personal data, prevail.
If you exercise your right of objection, we will no longer process the data concerned, unless we can prove compelling reasons worthy of protection for the processing which outweigh your interests, rights and freedoms, or that the processing serves to assert, exercise or defend legal claims.

(16) IN THE EVENT THAT WE PROCESS PERSONAL DATA FOR DIRECT MARKETING (E. G. NEWSLETTER), YOU MAY AT ANY TIME OBJECT TO THE PROCESSING OF PERSONAL DATA CONCERNING YOU FOR THE PURPOSE OF SUCH ADVERTISING WITH THE CONSEQUENCE THAT WE WILL NO LONGER PROCESS YOUR DATA FOR THIS PURPOSE.

(17) If you consider that the processing of your personal data is contrary to the DSGVO, you may lodge a complaint with a supervisory authority, in particular in the Member State where you are staying, working or allegedly infringing. This does not exclude other official or judicial remedies.
