Thank you very much for your visit!
We usually ship your order within two days. Within Germany, delivery should not take more than three to four days. In Europe, please expect about a week to ten days. All other destinations, between two and three weeks. Due to COVID-related merchandise shipping restrictions to OVERSEAS DESTINATIONS — Deutsche Post (German Postal Service) has suspended air freight shipping of International Mail, so we had to revamped our delivery process — we are currently unfortunately unable to display that tracking information in Etsy. However, we are in possesion of all corresponding USPS tracking numbers, so if you have a question about the status or whereabouts of your order, please let us know and we will check it for you.

A - Terms and Conditions of Sale
1. Definitions and interpretation
In these Terms:
“Customer” means the customer for the Products sold by VILLA SORGENFREI SCHMUCKMANUFAKTUR GmbH;“Force Majeure Event” means an event, or a series of related events, that is outside the reasonable control of the party affected (including power failures, industrial disputes affecting any third party, changes to the law, disasters, explosions, fires, floods, riots, terrorist attacks and wars);
“Prices” means VILLA SORGENFREI SCHMUCKMANUFAKTUR GMBH’s prices for the Products as published on the website;
“Products” means the products which may be or are purchased by the Customer from VILLA SORGENFREI SCHMUCKMANUFAKTUR GmbH under these Terms;
“Supplier” means VILLA SORGENFREI SCHMUCKMANUFAKTUR GmbH,
“Terms” means these terms and conditions of supply.
2. These Terms
These Terms contain the only conditions upon which the Supplier will deal with the Customer, and they govern all Contracts to the exclusion of all other terms and conditions.
3. Contracts
Each order for Products given by the Customer to the Supplier will be deemed to be an offer by the Customer to purchase Products from the Supplier subject to these Terms.
4. Delivery
4.1 All Products will be delivered by the Supplier to the Customer's address;
the Supplier will be responsible for arranging transport for the Products;
the Customer will be responsible for paying all costs relating to the import of the Products;
risk in the Products will pass from the Supplier to the Customer when the Products are delivered to the Customer.
4.2 Any date or dates for the delivery of the Products agreed by the parties as part of a Contract will not be of the essence of the Contract.
5. Title
Legal and equitable title to the Products will pass from the Supplier to the Customer upon receipt by the Supplier of all amounts due from the Customer to the Supplier.
6. Customer’s obligations
The Customer must comply with all applicable laws, rules and regulations relating to, and must obtain all licences, permits and approvals required in relation to import of the Products.
7. Prices and payment
All amounts payable are exclusive of all value-added, goods and services, sales, export, import, and other taxes and duties which will be payable by the Customer (except for taxes payable on the Supplier's net income, which will be payable by the Supplier).
8. Warranties
The Supplier warrants that:
(a) the Supplier has the right to sell the Products;
(b) the Products are free from any charge or encumbrance, disclosed or known to the Customer before the relevant Contract is made;
(c) the Products correspond to any description of the Products supplied by the Supplier to the Customer;
(d) the Products are of satisfactory quality;
(e) the Products are fit for any purpose made known by the Supplier to the Customer before the relevant Contract is made;
9. Complaints, credits and replacements
9.1 The Supplier will promptly and in any event within 30 Business Days fully respond to all reasonable enquiries and complaints by the Customer relating to the quality, performance and durability of the Products.
9.2 If Products do not comply with any warranty given by the Supplier under a Contract, the Customer may with the prior agreement of the Supplier return those Products for either (at the option of the Supplier):
(a) a full credit of the price paid to the Supplier for such Products (excluding any third party charges);
(b) replacement Products; or
(c) a credit note in respect of the Price of the Products (to be offset against future purchases from the Supplier).
9.3 Products returned must be properly packed and returned to VILLA SORGENFREI within 30 Business Days of receipt of the Products by the Customer. Any Products returned in contravention of this Clause will not be the subject of any credits or replacements and the Customer will continue to be liable for payment of the Price in respect of such Products.
10. Liability
10.1 The Supplier will not be liable in respect of any loss of profits, income, revenue, use, production or anticipated savings.
10.2 The Supplier will not be liable for any loss of business, contracts or commercial opportunities.
10.3 The Supplier will not be liable for any loss of or damage to goodwill or reputation.
10.4 The Supplier will not be liable in respect of any loss or corruption of any data, database or software.
10.5 The Supplier will not be liable in respect of any special, indirect or consequential loss or damage.
10.6 The Supplier will not be liable for any losses arising out of a Force Majeure Event.
11. Contract termination
A Contract may be terminated in the following circumstances:
(a) the Supplier may terminate any Contract immediately by giving written notice to the Customer if the Customer fails to pay to the Supplier any amount due by the due date for payment;
(b) the Supplier may terminate any Contract immediately by giving written notice to the Customer if the Customer fails to accept delivery of the Products.
12. General
13.1 No breach of any provision of a Contract will be waived except with the express written consent of the party not in breach.
13.2 If any provision of a Contract is determined by any relevant court or other competent authority to be unlawful and/or unenforceable, the other provisions of the Contract will continue in effect. If any unlawful and/or unenforceable provision would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect (unless that would contradict the clear intention of the parties, in which case the entirety of the relevant provision will be deemed to be deleted).
13.3 Contracts may not be varied except by a written document signed by or on behalf of each of the parties.
13.4 The Supplier may freely assign its rights and obligations under a Contract without the Customer’s consent.
13.5 Each Contract is made for the benefit of the parties, and is not intended to benefit any third party or be enforceable by any third party.
13.6 These Terms will constitute the entire agreement between the parties. Neither party will have any remedy in respect of any misrepresentation (whether written or oral) made to it upon which it relied in entering into a Contract.
13.7 Contracts will be governed by and construed in accordance with the Laws of the Federal Republic of GERMANY; and the courts of the Federal State of BERLIN will have exclusive jurisdiction to adjudicate any dispute arising under or in connection with a Contract.
14. Sale to commercial customers
The goods offered in the shop are sold directly to Customers which are end Customers only.
We therefore expressly reserve the right not to accept Contract (Orders) that appear to be made for the purpose of commercial resale of our Products.
14.1 Commercial re-sale
We generally exclude any commercial resale of our Products. The Order must contain the Products that are exclusively for non-commercial, private use. We therefore reserve the right not to accept Contracts (Orders) that appear to be submitted for the purpose of commercial resale of our Products.

§ 1 Grundlegende Bestimmungen
(1) Die nachstehenden Geschäftsbedingungen gelten für alle Verträge, die Sie mit uns als Anbieter (Villa Sorgenfrei Schmuckmanufaktur GmbH) schließen. Soweit nicht anders vereinbart, wird der Einbeziehung gegebenenfalls von Ihnen verwendeter eigener Bedingungen widersprochen.
(2) Verbraucher im Sinne der nachstehenden Regelungen ist jede natürliche Person, die ein Rechtsgeschäft zu Zwecken abschließt, die überwiegend weder ihrer gewerblichen noch ihrer selbständigen beruflichen Tätigkeit zugerechnet werden kann. Unternehmer ist jede natürliche oder juristische Person oder eine rechtsfähige Personengesellschaft, die bei Abschluss eines Rechtsgeschäfts in Ausübung ihrer selbständigen beruflichen oder gewerblichen Tätigkeit handelt.
§ 2 Zustandekommen des Vertrages
(1) Gegenstand des Vertrages ist der Verkauf von Waren.
(2) Wird ein Artikel von uns in unserem Webshop eingestellt, liegt in der Freischaltung der Angebotsseite das verbindliche Angebot zum Abschluss eines Kaufvertrages zu den in der Artikelseite enthaltenen Bedingungen.
(3) Die Zum Kauf beabsichtigten Waren sind im "Warenkorb" abgelegt. Über die entsprechende Schaltfläche in der Navigationsleiste können Sie den "Warenkorb" aufrufen und dort jederzeit Änderungen vornehmen. Nach Aufrufen des Bestellformulars erfolgt die Eingabe der persönlichen Daten sowie der Zahlungs- und Versandbedingungen. Vor Absenden der Bestellung haben Sie die Möglichkeit, sämtliche Angaben nochmals zu überprüfen, zu ändern (auch über die Funktion "zurück" des Internetbrowsers) bzw. den Kauf abzubrechen. Mit dem Absenden der Bestellung über die Schaltfläche "kostenpflichtig bestellen" kommt der Kaufvertrag verbindlich zu Stande.
(4) Die Abwicklung der Bestellung und Übermittlung aller im Zusammenhang mit dem Vertragsschluss erforderlichen Informationen erfolgt per E-Mail zum Teil automatisiert. Sie haben deshalb sicherzustellen, dass die von Ihnen bei uns hinterlegte E-Mail-Adresse zutreffend ist, der Empfang der E-Mails technisch sichergestellt und insbesondere nicht durch SPAM-Filter verhindert wird.
5) Die Bestimmungen zum Export bzw. Import von Schmuck aus Deutschland in die SCHWEIZ sind umfänglich und verursachen leider einen Aufwand, den wir als kleiner Betrieb personell und finanziell leider nicht leisten können. Deshalb können wir leider nicht in die Schweiz verkaufen. Bestellungen aus der Schweiz werden deshalb storniert und die zugehörige Zahlung unmittelbar erstattet. Für die Unannehmlichkeit entschuldigen wir uns und bitten um Verständnis.
§ 3 Kein Verkauf an gewerbliche Abnehmer
Die im Webshop angebotene Ware wird nur an Verbraucher als Endverbraucher verkauft.
Wir behalten uns daher ausdrucklich vor, Vertragsangebote (Bestellungen), die den Anschein erwecken, zum Zwecke des gewerblichen Weiterverkaufs der Ware abgegeben zu werden, nicht anzunehmen.
§ 4 Zurückbehaltungsrecht, Eigentumsvorbehalt
(1) Ein Zurückbehaltungsrecht können Sie nur ausüben, soweit es sich um Forderungen aus demselben Vertragsverhältnis handelt.
(2) Die Ware bleibt bis zur vollständigen Zahlung des Kaufpreises unser Eigentum.
§ 5 Haftung
(1) Wir haften jeweils uneingeschränkt für Schäden aus der Verletzung des Lebens, des Körpers oder der Gesundheit, in allen Fällen des Vorsatzes und grober Fahrlässigkeit, bei arglistigem Verschweigen eines Mangels, bei Übernahme der Garantie für die Beschaffenheit des Kaufgegenstandes, bei Schäden nach dem Produkthaftungsgesetz und in allen anderen gesetzlich geregelten Fällen.
(2) Sofern wesentliche Vertragspflichten betroffen sind, ist unsere Haftung bei leichter Fahrlässigkeit auf den vertragstypischen, vorhersehbaren Schaden beschränkt. Wesentliche Vertragspflichten sind wesentliche Pflichten, die sich aus der Natur des Vertrages ergeben und deren Verletzung die Erreichung des Vertragszweckes gefährden würde sowie Pflichten, die der Vertrag uns nach seinem Inhalt zur Erreichung des Vertragszwecks auferlegt, deren Erfüllung die ordnungsgemäße Durchführung des Vertrags überhaupt erst möglich machen und auf deren Einhaltung Sie regelmäßig vertrauen dürfen.
(3) Bei der Verletzung unwesentlicher Vertragspflichten ist die Haftung bei leicht fahrlässigen Pflichtverletzungen ausgeschlossen.
(4) Die Datenkommunikation über das Internet kann nach dem derzeitigen Stand der Technik nicht fehlerfrei und/oder jederzeit verfügbar gewährleistet werden. Wir haften insoweit weder für die ständige noch ununterbrochene Verfügbarkeit der Webseite und der dort angebotenen Dienstleistung.
(5) Die von der DHL Paket GmbH den Endkunden/Empfängern angebotenen Zustelloptionen WUNSCHORT und WUNSCHNACHBAR schließen die Haftung für die Zustellung aus. Wenn Sie also dieses Angebot von DHL wahrnehmen, besteht KEINE HAFTUNG mehr für die Unversehrtheit sowie den Inhalt der Sendung. Mit der Wahl der Zustellung an Wunschort oder Wunschnachbar trägt der Empfänger das volle VERLUSTRISIKO und wir können den Schaden dann leider NICHT ERSETZEN.
(6) Die Bestimmungen zum Export bzw. Import von Schmuck aus Deutschland in die SCHWEIZ sind umfänglich und verursachen leider einen Aufwand, den wir als kleiner Betrieb personell und finanziell leider nicht leisten können. Deshalb können wir leider nicht in die Schweiz verkaufen. Bestellungen aus der Schweiz werden deshalb storniert und die zugehörige Zahlung unmittelbar erstattet. Für die Unannehmlichkeit entschuldigen wir uns und bitten um Verständnis.
§ 6 Gewerblicher Weiterverkauf
Einen gewerblichen Weiterverkauf unserer Produkte schließen wir ausnahmslos grundsätzlich aus. Mit der Bestellung ist also explizit anerkannt, dass alle darin enthaltenen Artikel ausschließlich der nichtgewerblichen privaten Verwendung gelten. Wir behalten uns daher ausdrücklich vor, Vertragsangebote, die den Anschein erwecken, zum Zwecke des gewerblichen Weiterverkaufs der Ware abgegeben zu werden, nicht anzunehmen.
§ 7 Rechtswahl, Erfüllungsort, Gerichtsstand

The payment options in our shop are offered, managed and processed entirely by Etsy and its affiliates directly, we then only receive the payments minus all fees settled by Etsy as a regular bank transfer in toto into our bank acount. Shipping

We usually ship your order within three days. Within Germany, delivery should not take more than three to four days. In Europe, please expect about a week to ten days. All other destinations, between two and three weeks. Due to COVID-related merchandise shipping restrictions to OVERSEAS DESTINATIONS — Deutsche Post (German Postal Service) has suspended air freight shipping of International Mail, so we had to revamped our delivery process — we are currently unfortunately unable to display that tracking information in Etsy. However, we are in possesion of all corresponding USPS tracking numbers, so if you have a question about the status or whereabouts of your order, please let us know and we will check it for you.

The regulations on the export and import of jewelry from Germany to SWITZERLAND are extensive and cause an effort that we, as a small company, cannot do in terms of personnel and money. For that reason, we are unfortunately not able to sell to Switzerland. All orders from Switzerland will be therefore canceled, and the payment refunded immediately.

- I would like to order two items, will this reduce the shipping costs?
Shipping costs are always calculated only for the first item in one order, all other pieces in the same order are then free of shipping cost.
- My article has been marked as shipped for days but has not arrived yet.
Up to five business days mailing time, so from the dispatch notification / marking should please wait, then, however, unfortunately, there is probably some error ... (eg post has forgotten to insert notification card for parcels and it is unnoticed at the post office or at neighbors, or the shipment is unfortunately lost). In the run-up to Christmas, it sometimes takes longer.
- What happens if a shipment has been proven to be lost?
We will send it to you again. (If a lost item is no longer available, the purchase price will be refunded.)

Without exception, we exclude any commercial resale of our products. The order therefore explicitly recognizes that all articles contained therein are exclusively for non-commercial private use.
- Who is behind the Villa Sorgenfrei Schmuckmanufaktur GmbH?
The two partners of Villa Sorgenfrei Schmuckmanufaktur GmbH are the founder and designer of Villa Sorgenfrei Schmuckmanufaktur Claudia Pöpsel and her husband Dirk Dotzert, who as managing director covers the administrative part.

As a precaution, unfortunately, we must explicitly point out that all of our jewelery designs originally created by Claudia Pöpsel are legally protected by law. Likewise, the inttelctual property and/or copyright laws may be relevant. So please do NOT COPY the jewelery with which Claudia goes out of her way, spends a lot of talent, energy, time and passion, and is therefore very unhappy about imitations and imitators. Copying jewelry designs, including their names and descriptions, as well as copying or imitating their photos, is uncreative, unfair, and unlawful, and therefore can unfortunately have very serious legal consequences for imitators, including, but not limited to, e.g. Injunctive relief claims and damages in each case.

Notes on battery disposal
In connection with the distribution of batteries or the supply of devices containing batteries, we are obliged to inform you of the following:
You are legally obliged to return used batteries as end users. You can return used batteries, which we have as new batteries in the range or have led, free of charge to our shipping warehouse (shipping address). The symbols shown on the batteries have the following meaning:
The symbol of the crossed-out wheelie bin means that the battery must not be disposed of with household waste.

Note on the recycling of used batteries
You are legally obliged as end user to recycle used batteries. In Germany, any point of sale that sells batteries must also accept such used batteries. There are also public and private waste disposal companies. You can also return used batteries, which you have received from us as new batteries (Freienwalder Str. 17, 13055 Berlin).
