Cancellation PolicyRight of cancellation As a consumer, you have the right to cancel the contract in writing (e.g. per letter, fax, e-mail) within one month without stating a reason. The one month period begins after receipt of this written notification, but not before the contract has been entered into and not before we have fulfilled our information obligations in accordance with article 246 section 2 in conjunction with section 1 paragraph 1 and 2 EGBGB [Introductory Act to the Civil Code] and our obligations in accordance with section 312e paragraph 1 sentence 1 BGB [German Civil Code] in conjunction with article 246 section 3 EGBGB [Introductory Act to the Civil Code]. Consequences of cancellation
In the event of a valid cancellation each party shall return to the other party the goods and services received including any benefits (e.g. interest). If you are not able to return the good or services received from us in whole or in part or if you are only able to return them in a deteriorated condition, you may be obliged to pay compensation. Obligations to reimburse payments must be fulfilled within 30 days. For the customer, this 30 day period starts with the dispatch of the notice of cancellation. For us, this 30 day period starts with the receipt of the notice of cancellation. We do not reimburse payments in cash; therefore please state your bank account details in the event of cancellation.
In the case of services, your right of cancellation expires prematurely where the party with whom you have entered into the contract has started executing the service with your express consent or by your arrangement before the end of the cancellation period. Your right of cancellation expires in particular if the voucher has already been redeemed in whole or in part. Only you, as the party to the contract, have the right to cancel; the person receiving the voucher has no right of cancellation.
Terms and Conditions for Vouchers
Our General Terms and Conditions of Business and Data Protection Policy apply for the purchase of vouchers. The following terms and conditions for vouchers also apply:
- Subject matter
The DaWanda voucher can be used when making purchases on the DaWanda platform as specified in these terms and conditions. After payment of the voucher value has been received, the voucher will be sent to you in the form of an e-mail together with a voucher code. You may then pass the voucher on to a third party. In the event that you pass on the voucher, you agree not to use the voucher code further or disclose it to other third parties. In transferring the voucher to you, DaWanda agrees to pay the purchase price (up to the amount of the value of the voucher) directly to the seller as a third party when the voucher code is entered during a purchase on the DaWanda platform. With this payment to the seller DaWanda fulfils (or partially fulfils) its duty of performance arising from the voucher.
- Redeeming the voucher
The voucher can be used to purchase a product offered on the platform www.dawanda.com. The voucher is redeemed by entering the voucher code in the appropriate box on www.dawanda.com when purchasing the item. Preconditions for redeeming the voucher are:
- that the offer in question accepts the use of vouchers as payment (listed under payment method in the item’s description)
- that the item in question in addition to DaWanda voucher also can be paid for by bank transfer or via PayPal and either of these payment methods is agreed upon (the voucher may not be used for payment on delivery, cash payments, etc.)
- that no advance performance by the seller is required.
If the purchase price of the item for which the voucher is used exceeds the value of the voucher then the remaining amount must be paid by the purchaser to the seller without delay and in accordance with the relevant terms and conditions of the seller. Vouchers cannot be paid out in cash, either in whole or in part.
Vouchers must be redeemed by the end of the third year following the dispatch of the voucher code at the latest; vouchers are no longer valid after this period.
You agree not to disclose the voucher code to any person other than the person to whom you wish to gift the voucher. Please take particular care in entering your e-mail address when ordering and when forwarding the relevant e-mails. DaWanda is not liable for any typing errors in the e-mail address. DaWanda is not liable for the loss, theft or fraudulent use or delayed transfer (e.g. through technical problems) of the voucher code.
- Fraud In the event that DaWanda discovers fraud or attempted fraud in connection with the purchase or redemption of vouchers on the www.dawanda.com platform, DaWanda is entitled to block the relevant member accounts and/or demand that alternative payment is made directly to the seller when the voucher is used. In such an event, you do not have the right to redeem the relevant vouchers or to have them paid out in cash.
