General Terms and Conditions for the etsy Shop with the seller name "stoffparadies"

I. General and business relations

The following General Terms and Conditions apply to the contractual relationships between the seller and his customers (hereinafter referred to as "Buyer") concluded within the framework of the etsy shop with the dealer name "stoffparadies" of Susanne Winkler, Fürstenhof 53, 59368 Werne (hereinafter referred to as "Seller").

1. Contracts are concluded with both consumers and entrepreneurs.

2. A consumer is any natural person who concludes a legal transaction for purposes that can predominantly be attributed neither to their commercial nor their independent professional activity.

3. According to § 14 BGB,an entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of his commercial or self-employed professional activity. A partnership with legal capacity is a partnership that is equipped with the ability to acquire rights and enter into liabilities.

II. Conclusion of the contract

1. By listing an item on Etsy, the seller makes a binding offer to sell that item.

2. The Customer may accept the Seller's offer via the online order form provided by Etsy. To do this, the customer must first place the desired item in the virtual shopping cart at Etsy and then go through the order steps specified by Etsy. By clicking on the button that concludes the ordering process, the customer declares the acceptance of the offer, whereby a purchase contract for the goods previously selected by the customer is concluded.

3. By purchasing an item, you agree to the terms and conditions and terms of delivery of the respective store as specified in the item description and in the seller's terms and conditions, provided that these terms are not in conflict with these terms of use or are invalid by law.

4. Purchase contracts can only be cancelled in exceptional cases, such as if the seller changes the item description after conclusion of the contract, there is a clear typographical error or the identity of the seller is unclear.

5. As a buyer, you need to make sure that you are legally able to make purchases on etsy.

III. Delivery, shipping costs, packaging costs and transfer of risk

1. Insofar as a delivery (delivery to the shipping company) has been agreed between the seller and the buyer, this will take place immediately after receipt of money. The shipping and packaging costs and the delivery date can be found in the respective article description. There, for the respective countries to which the corresponding items are shipped, the shipping and packaging costs are displayed exactly as a total amount.

2. If the buyer is a consumer within the meaning of § 13 BGB, the shipping risk shall be borne exclusively by the seller. If, on the other hand, the buyer is an entrepreneur, the risk shall pass to the buyer as soon as the seller has delivered the item to the freight forwarder or to the persons or institution otherwise designated to carry out the shipment.

IV. Prices, VAT, Payment

1. When purchasing via an online auction platform, the price at which the purchase contract was concluded shall apply. All prices quoted are therefore total prices including vat plus shipping costs and packaging costs. The additional shipping and packaging costs can be found in the item description.

2. The payment methods granted (PayPal, direct debit, credit card, bank transfer) can be found in the item description of the respective offer. For payments by "Etsy Voucher", the Etsy Voucher Terms and Conditions apply, which can be viewed under www.etsy.com/de/help/article/3292.


V. Liability for defects/liability

VI. Retention of title

Consequences of revocation

The right of withdrawal may expire

- for the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene, if their seal has been removed after delivery,
- for the delivery of goods if they have been inseparably mixed with other goods after delivery due to their nature,

VIII. Further information requirements for distance contracts and for electronic commerce

1. Information about the technical steps leading to the conclusion of a contract

After selecting an item, place it in the virtual shopping cart via the link "add to cart". Then another window will appear where you can decide whether you want to continue the payment process immediately, or look at other products of the seller. Then you will be taken to the order overview, in which the total price including packaging and shipping is listed exactly as the total amount, as well as mentioning the individual sums. You also have the option of deleting the selection again. Furthermore, there is the possibility to increase the corresponding number of articles at this point. If you now want to continue the ordering process, press the link "Checkout". Another mask will then appear in which you can first specify the delivery address. It is also possible to specify a different billing address. In addition, your order will be displayed again in detail. You then have to choose a payment method. It is also possible to send a separate message for the order to the seller. 2. Storage of the contract text after conclusion of the contract as well as accessibility for the customer.
