A. Basic provisions
I. The following terms and conditions apply to all contracts that you (hereinafter: customer) conclude with us, WoolAffair GbR, Heidrun and Lisa Schramm (hereinafter: provider) via the etsy platform.

III. A consumer within the meaning of the following regulations is any natural person who concludes a legal transaction predominantly for purposes that can neither be attributed to their commercial nor independent professional activity.
Entrepreneurs are natural or legal persons who act predominantly for commercial or independent professional purposes.


B. Conclusion of the contract
I. The object of the contract is the sale of digital and physical goods.

II. A product posted by us is to be regarded as a binding offer under the conditions contained in the description after activation by etsy.

III. The purchase contract is concluded via the online shopping cart system provided by etsy as follows:
The customer places the goods he wants to buy in the shopping cart. The shopping cart can be changed at any time via the corresponding button. After selecting the desired payment method and calling up the page "Checkout" or the check-out via PayPal "Buy with PayPal", the customer enters his personal data and the required data for the payment method. Finally, all order data is displayed on the order overview page.
If the customer uses an instant payment system such as .B PayPal or Sofortüberweisung, he will be forwarded to the provider of the payment system in the next step. After completion of the transaction, the customer will be redirected back to etsy for the order overview page.

Before sending the order, the customer is again given the opportunity to correct any errors or to cancel the purchase.
By sending the order via the corresponding button, the customer accepts the offer of the provider in a legally binding manner and the purchase contract is concluded.

The processing of the order and the transmission of all information related to the purchase contract are carried out by e-mail and partly automated. The customer must ensure receipt of the e-mails.

IV. Contract language is german. The complete text of the contract will not be stored by us. Before sending the order, the contract data can be printed out or electronically saved via the print function of the browser. After receipt of the order by the provider, the order data, the legally prescribed information for distance contracts and the General Terms and Conditions will be transmitted to the customer again by e-mail.


C. Prices and terms of payment
I. The prices quoted by the provider are to be understood as total prices and include the statutory value added tax.

II. Any shipping costs are not included in the purchase price, but can be called up via a corresponding button on the website or in the course of the offer. Shipping costs will be shown separately in the course of the ordering process and are to be borne additionally by the customer, unless free shipping has been promised.

III. In any case, digital goods are free of shipping costs.

IV. If the delivery is made to countries that are not members of the EU, further costs for which we are not responsible, such as e.B taxes, customs duties or money transfer fees, may be incurred, which are to be borne by the customer. Any costs incurred for the transfer of money must also be borne by the customer if the delivery is made to an EU member state, but the payment was initiated outside the EU.

V. The provider provides the payment method Etsy Payments, the customer can choose from the offered payment methods.
Etsy Payments includes the following payment methods:

When using the Etsy Payments payment method, the payment is processed via Etsy Ireland UC, 66/67 Great Strand Street, Dublin 1, Ireland (hereinafter: Etsy UC) provided that the payment is not made in the currencies US dollars or Canadian dollars. Payment is then processed via Etsy Inc., 117 Adams Street, Brooklyn NY 11201, United States of America.

VI. Unless otherwise stated for the individual payment methods, the payment claims from the concluded contract are due immediately.


D. Terms of delivery
I. The terms of delivery, the delivery time and, if applicable, existing delivery restrictions can be found under a correspondingly designated button on our website or in the respective offer.

Insofar as no other period is specified in the respective offer or under the correspondingly designated button, the physical goods will be delivered within 6-8 working days after conclusion of the contract.
Digital goods are available for download immediately after conclusion of the contract. The customer separately contains an automatically generated e-mail with a link that leads him to the download. For customers with an existing customer account with etsy, the download is also available in this one.

II. The following applies to transport damage:
For consumers: If goods are delivered with obvious transport damage, please complain about such errors as soon as possible to the deliverer and contact us immediately. The failure to make a complaint or contact has no consequences for your legal claims and their enforcement, in particular your warranty rights. However, they help us to assert our own claims against the carrier or the transport insurance.
For entrepreneurs: The risk of accidental loss and accidental deterioration shall pass to you as soon as we have delivered the item to the freight forwarder, the carrier or the person or institution otherwise designated to carry out the shipment. Among merchants, the obligation to inspect and give notice of defects regulated in § 377 HGB (German Commercial Code) applies. If you fail to make the notification regulated therein, the goods shall be deemed to have been approved, unless it is a defect that was not recognizable during the inspection. This does not apply if we have fraudulently concealed a defect.


E. Right of retention and retention of title
I. The goods remain our property until full payment has been made.
For entrepreneurs, the following also applies: We reserve title to the goods until all claims arising from an ongoing business relationship have been settled in full. The entrepreneur may resell the reserved goods in the ordinary course of business; he assigns all claims arising from this resale – regardless of a combination or mixing of the reserved goods with a new item – in the amount of the invoice amount to the provider in advance and the provider accepts this assignment. The entrepreneur remains authorized to collect the claims, but the provider may also collect claims himself if the entrepreneur does not meet his payment obligations.

II. The customer can only exercise a right of retention if it concerns claims from the same contractual relationship.


F. Warranty
I. Unless expressly agreed otherwise below, the statutory right to liability for defects shall apply.

II. Defects that occur within one year of delivery of the goods can be asserted within the statutory limitation period of two years from delivery of the goods.

III. For entrepreneurs, the limitation period for claims for defects in newly manufactured items is one year from the transfer of risk. The statutory limitation periods for the recourse claim according to § 445a BGB remain unaffected.
With regard to entrepreneurs, only our own information and the manufacturer's product descriptions, which have been included in the contract, shall be deemed to be an agreement on the quality of the goods; We assume no liability for public statements of the manufacturer or other advertising statements.
If the delivered item is defective, the Provider shall initially provide warranty to entrepreneurs at its discretion by remedying the defect (rectification) or by delivering a defect-free item (replacement delivery).
The above restrictions and shortened deadlines do not apply to claims due to damages caused by the provider, its legal representatives or vicarious agents
• in case of injury to life, body or health
• in case of intentional or grossly negligent breach of duty as well as malice
• in the event of a breach of essential contractual obligations, the fulfilment of which makes the proper execution of the contract possible in the first place and on the observance of which the contractual partner may regularly rely (cardinal obligations)
• within the framework of a guarantee promise, if agreed
• insofar as the scope of application of the Product Liability Act is opened.


G. Final provisions
I. German law shall apply. In the case of consumers, this only applies to the extent that the protection afforded by mandatory provisions of the law of the state of the consumer's habitual residence is not withdrawn.

II. For entrepreneurs, German law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods.

III. The European Commission provides a platform for online dispute resolution (OS), which you can find here. We are not obliged and unwilling to participate in a dispute resolution procedure before a consumer arbitration board.

The dispatch of our digital goods (pdf instructions) takes place via download. The link to the download will be sent by e-mail after completion of the purchase. The shipment of our physical products (yarns and wool packages) takes place with DHL or Deutsche Post after receipt of money.

Yarns made according to customer requirements with regard to color design and running length are excluded from exchange.
