Section 3 – Prices and payment

(1) All product prices are total prices plus shipping costs. Prices include VAT.

(3) The Customer can pay by credit card (VISA, MasterCard, American Express). In the Cart section, additional means of payment may be available, such as PayPal or Klarna (“Sofort.”).

(4) Customer payments may be received by Etsy Ireland UC, 66/67 Great Strand Street, Dublin 1, Ireland, or, if payment is made in US$ oder CAN$, by Etsy Inc., 117 Adams Street, Brooklyn, NY, USA, (“Etsy” for short) on behalf of the Vendor. Etsy shall forward the amount paid to the Vendor.

(5) The Vendor reserves ownership of the delivered goods until the Customer has paid their purchase price in full.

Shipping policy

The delivery takes place by sending the object of purchase to the address communicated by the customer. The supplier delivers the goods within 1-5 working days from payment (upon receipt).
Deliveries are usually made by parcel services. These deliver at the usual times and leave a message in the absence of the orderer to arrange a new delivery. This information is not binding, unless otherwise agreed or stated. For delays on the part of the parcel delivery agent, fair-art Atelier Steffen Karol can not accept any liability. If the delivery to the customer fails because the customer has given the delivery address incorrectly or incompletely, another attempt to deliver will only be made if the customer bears the direct costs of the new shipment. These costs correspond to the shipping costs agreed upon conclusion of the contract.
Several simultaneously ordered products are delivered in a common shipment; For the joint shipment, the delivery time of the product with the longest delivery time applies. If the customer wishes to deliver a specific product in advance with a shorter delivery time, he must order this product separately.
For products that are marked in the product description as "custom-made possible", the delivery time increases accordingly with the coordination with the supplier, if the customer orders such a "custom-made".
The delivery takes place against the specified packaging and shipping costs. For foreign deliveries, unless otherwise stated, the price for packaging and shipping will be charged separately. If the customer wishes a special kind of dispatch, with which higher costs arise, then he has to bear these additional costs.
For shipments to destinations outside Germany, the delivery time increases accordingly.
If the customer has chosen to pay in cash, the goods will not be sent. Instead, the purchaser can pick up the goods at the place of business of the provider after the expiration of 2 working days after the conclusion of the contract; for custom-made products, the time to completion is extended accordingly.
Note on participation in the return system of Landbell AG:
With regard to sales packaging filled with goods and delivered to private end consumers, our company has joined the nationwide take-back system of Landbell AG, Mainz, to ensure compliance with our statutory obligations pursuant to Section 6 VerpackV. Further information can be found on the Landbell AG website.

Part I - General Terms and Conditions

Section 1 – Vendor, inclusion by reference of the General Terms and Conditions

(1) The Vendor and contracting party for the merchandise presented in the Etsy Shop „karolart“ is Steffen Karol, Am Schloßgarten 12, 07381 Wernburg, phone (03647)447870, e-mail (referred to sk-gaia [!at] gmx.de as the “Vendor” for short).

(2) The present General Terms and Conditions are a component part of any contractual agreement made between the Vendor and the respective Customer. The Vendor hereby objects to any terms and conditions that the Customer may have established and that contradict the present General Terms and Conditions.

Section 2 – Merchandise offered and conclusion of contract

(1) The Vendor is offering the merchandise presented in the Etsy Shop “karolart” for sale to other Etsy users. The colors of the merchandise shown on the website may vary slightly depending on the internet browser and monitor settings used by the Customer; these variations are technically unavoidable.

(2) Selection of merchandise, conclusion of contract and implementation of the agreement shall all take place in German.

(3) The Customer shall select the merchandise desired by placing it in his “Cart” (“Warenkorb”). When the cart contains all merchandise desired, the Customer proceeds to the checkout by clicking on “Proceed to Checkout” (“Zur Kasse gehen”). The following page titled “Please confirm and submit your order” shall display a summary, so that the Customer can check for any incorrect input. On this page, the Customer can place his order with the Vendor by clicking on the button “Pay now” (“Jetzt bezahlen”); where the Customer uses Klarna (“Sofort”) for payment, the order will be placed with the Vendor by clicking on the button “Next” (“Weiter”) on the page titled “Transaction confirmation” (“Transaktion bestätigen”). Until the order is transmitted to the Vendor, the Customer may go back one or multiple steps in the browser to modify the data input or to completely discontinue the order.

(4) The Vendor is making a binding sales offer for the merchandise presented in his shop. By transmitting the order using the button “Pay Now” (“Jetzt bezahlen”), the Customer accepts the sales offer; The Vendor shall confirm the conclusion of the contract by e-mail (contract confirmation).

(5) The content of a contract concluded is stored by Etsy in the Vendor’s and the Customer’s Etsy user accounts and may be viewed by the Customer in his user account on the Etsy portal in section “Purchases and Reviews” (“Einkäufe und Bewertungen”) in the “You” (“Du”) menu. After conclusion of a contract, Etsy shall also send an e-mail with the content of the contract to the Customer. Beyond that, the Vendor neither saves the content of the contract nor does he provide access to it outside the Etsy platform.

(6) The Vendor shall inform the Customer by e-mail of any impediments preventing the delivery from being made, or of any other circumstances that might prevent contractual performance.

Section 4 – Right of withdrawal for consumers

(1) A Customer purchasing as consumer is entitled to a right of withdrawal in accordance with the statutory pre-requisites.

(2) A consumer means every natural person who enters into a legal transaction for a purpose that is mainly outside his commercial or self-employed professional activity.

(3) The pre-requisites and legal consequences of the German stipulations as to consumers' rights of withdrawal shall apply to consumers having their permanent residence outside of Germany also in those cases in which the consumer's national law does not provide for a right of withdrawal or provides for a shorter withdrawal period or for stricter requirements as to form.

Section 5 – Warranty

Warranty claims shall be governed by the statutory regulations.

Section 6 – Alternative dispute resolution

(1) For settling consumer disputes out-of-court, the European Union offers a platform for online dispute resolution at ec.europa.eu/consumers/odr („ODR platform“).

(2) The provider is neither obliged nor willing to participate in an out-of-court consumer dispute resolution procedure.

Section 7 – Final provisions

(1) The laws of the Federal Republic of Germany shall apply, to the exclusion of the United Nations Convention on the International Sale of Goods (UNCISG). However, German law shall not apply to transactions with consumers having their permanent residence abroad to the extent the national laws applicable to those consumers set out provisions that cannot be contracted out to the detriment of the consumers.

(2) Should individual provisions of the present General Terms and Conditions prove to be invalid or impossible to implement, this shall not affect the validity of the remaining provisions.

(3) Wenn Sie über Etsy einen Vertrag mit uns abschließen, übermittelt Etsy uns Ihren Etsy-Nutzernamen (wenn Sie nicht als „Gast“ kaufen), Ihren Namen und die Rechnungsadresse, wie sie in Ihrem Etsy-Nutzerkonto hinterlegt sind bzw. Sie sie im Zuge des Vertragsschlusses angegeben haben. Soweit Sie im Rahmen Ihrer Bestellung weitere Daten angeben (z.B. eine abweichende Lieferadresse oder eine Telefonnummer), werden auch diese an uns übermittelt.

(4) Wir verarbeiten die in Absatz 3 genannten Daten elektronisch zur ordnungsgemäßen Vertragserfüllung, insbesondere für die Lieferung, die Rechnungsstellung, die Verbuchung von Zahlungen und die Bearbeitung von Retouren und Reklamationen. Diese Datenverarbeitung erfolgt auf Grundlage von Artikel 6 Absatz 1 Buchstabe b DSGVO. Wir halten diese Daten gespeichert, bis alle gegenseitigen Ansprüche aus dem jeweiligen Vertragsverhältnis mit Ihnen vollständig erledigt und die handels- und steuerrechtlichen Aufbewahrungsfristen abgelaufen sind, denen wir unterliegen.

(5) Für einen Vertragsschluss zwischen Ihnen und uns ist es erforderlich, dass wir Ihren Namen und eine Lieferadresse erhalten. Die Erforderlichkeit der Bereitstellung dieser Daten ergibt sich unter anderem aus den Geschäftsbedingungen von Etsy sowie aus gesetzlichen Vorschriften (etwa § 312i Abs. 1 Ziffer 3 BGB, § 14 Abs. 4 UStG). Ohne Bereitstellung dieser Daten können Sie mit uns daher keinen Vertrag schließen.

(6) Soweit wir Ihnen aufgrund des Kaufvertrags physische Waren übersenden, übermitteln wir Ihren Namen und Ihre Versandanschrift ggf. an die Deutsche Post (Deutsche Post AG, 53113 Bonn) oder DHL (DHL Paket GmbH, 53113 Bonn) als Versanddienstleister, und zwar zum Zwecke der Zustellung der Sendung an Sie und ggf. der Retour Ihrer Sendung an uns auf Grundlage von Artikel 6 Absatz 1 Buchstabe b DSGVO.

(7) Für die Bezahlung eines Einkaufs erhebt und verarbeitet der von Ihnen gewählte Zahlungsdienstleister in Ihrem Auftrag Ihren Namen, Ihre Karten- oder Kontonummer und/oder weitere Daten, die für die jeweilige Zahlungsmethode erforderlich sind. Es gelten insoweit die Datenschutzbestimmungen des gewählten Zahlungsdienstleisters, und, wenn Empfänger der Zahlung Etsy ist, die Datenschutzrichtlinie von Etsy.

(8) Elektronische Marktplätze sind gemäß § 22f UStG verpflichtet, Absende- und Bestimmungsort einer Lieferung sowie den Zeitpunkt und die Höhe des Umsatzes aufzuzeichnen und den Finanzbehörden auf Anforderung mitzuteilen. Daher können diese Einzelheiten einer Lieferung, die Sie bestellt haben, gemäß Artikel 6 Absatz 1 Buchstabe c DSGVO den Finanzbehörden übermittelt werden.

(9) Wenn Sie uns eine Nachricht über „Frage stellen“, „Frage eine Spezialanfertigung an“ oder über eine ähnliche Funktion auf der Etsy-Plattform schicken, übermittelt uns Etsy Ihren Etsy-Nutzernamen, bzw., wenn Sie keinen Etsy-Nutzernamen haben, eine sonstige Absenderidentifikation zusammen mit Ihrer Nachricht (Rechtsgrundlage: Artikel 6 Absatz 1 Buchstabe a DSGVO). Wenn Sie uns eine Nachricht per E-Mail schicken, speichern wir Ihre Nachricht mit den Absenderdaten (Name, E-Mail-Adresse), um sie zu beantworten und auch auf eventuelle spätere Folgefragen von Ihnen reagieren zu können (Rechtsgrundlage: Artikel 6 Absatz 1 Buchstabe f DSGVO). Für den Empfang, die Speicherung und den Versand von E-Mails nutzen wir einen E-Mail-Anbieter, der für uns als Auftragsverarbeiter im Einklang mit Artikel 28 DSGVO tätig wird. Wir löschen die mit Ihrer Nachricht erhobenen Daten spätestens sechs Monate nach der letzten mit Ihnen geführten Kommunikation zu Ihrem Anliegen, vorbehaltlich der Reglung im folgenden Absatz.

(10) Wenn Sie uns eine rechtlich relevante Erklärung zum Vertragsverhältnis übermitteln (z.B. einen Widerruf oder eine Reklamation), ist Rechtsgrundlage für die Verarbeitung, unabhängig vom Übermittlungsweg, auch Artikel 6 Absatz 1 Buchstabe b DSGVO. In einem solchen Fall löschen wir die mit Ihrer Erklärung zusammenhängenden Daten, sobald alle wechselseitigen Ansprüche aus dem Vertragsverhältnis endgültig erledigt und die handels- und steuerrechtlichen Aufbewahrungsfristen abgelaufen sind.

(11) Auf den Seiten von Etsy können Social-Media-Buttons eingeblendet sein; sie sind an den Logos der Social-Media-Plattformen (im Folgenden „Plattformen“) zu erkennen (Facebook: blaues „f“, Pinterest: rotes „p“, Twitter: blaue Vogel-Silhouette). Es handelt sich dabei um Links zu den jeweiligen Plattformen mit Sitz in den USA. Ein Klick auf einen solchen Link ruft die Internetseite der jeweiligen Plattform auf, wobei die IP-Adresse des aufrufenden Endgeräts sowie die Adresse der Seite, von der aus verlinkt wird („Referrer“), an die aufgerufene Plattform in die USA übermittelt werden. Von uns selbst werden im Zusammenhang mit den Social-Media-Buttons jedoch keine Daten erhoben oder verarbeitet.

(12) Etsy setzt verschiedene Cookies ein. Cookies sind kleine Textdateien, die bei Ihrem Besuch der Etsy-Webseite auf Ihrem Endgerät gespeichert werden und anhand derer Etsy und bestimmte Dienstleister, mit denen Etsy zusammenarbeitet, Ihr Endgerät beim nächsten Besuch wiedererkennen können. Wie diese Cookies funktionieren und welchen Zwecken sie im einzelnen dienen, erläutert Etsy unter www.etsy.com/de/legal/cookies-and-tracking-technologies . Sie können den Einsatz der Etsy-Cookies beeinflussen über den Link „Datenschutzeinstellungen“, den Sie am Ende einer jeden Etsy-Seite finden. Wir — als Anbieter des einzelnen Etsy-Shops karolart — haben keinen Zugriff auf die Cookies und auch nicht auf die damit verbundenen Daten.

(13) Wir verzichten auf eine automatisierte Entscheidungsfindung und auf Profiling.

(14) Bezüglich der personenbezogenen Daten, die wir über Sie verarbeiten, stehen Ihnen die folgenden Rechte zu:
a) Sie haben das Recht, von uns eine Bestätigung darüber zu verlangen, ob wir Sie betreffende personenbezogene Daten verarbeiten. Ist dies der Fall, so teilen wir Ihnen die über Sie gespeicherten personenbezogenen Daten und die weiteren Informationen gemäß Artikel 15 Abs. 1 u. 2 DSGVO mit.
b) Sie haben das Recht, Sie betreffende unrichtige personenbezogene Daten unverzüglich berichtigen zu lassen. Unter Berücksichtigung der Zwecke der Verarbeitung haben Sie auch das Recht, die Vervollständigung unvollständiger personenbezogener Daten – auch mittels einer ergänzenden Erklärung – zu verlangen.
c) Sie können von uns die unverzügliche Löschung der Sie betreffenden personenbezogenen Daten unter den Voraussetzungen von Artikel 17 Absatz 1 DSGVO verlangen, soweit deren Verarbeitung nicht gemäß Artikel 17 Absatz 3 DSGVO erforderlich ist.
d) Sie können von uns die Einschränkung der Verarbeitung Ihrer Daten verlangen, wenn eine der Voraussetzungen von Artikel 18 Absatz 1 DSGVO vorliegt. Sie können die Einschränkung insbesondere anstelle einer Löschung verlangen.
e) Wir werden jede Berichtigung oder Löschung Ihrer personenbezogenen Daten und eine Einschränkung der Verarbeitung allen Empfängern mitteilen, denen wir Sie betreffende personenbezogene Daten offengelegt haben, es sei denn, dies erweist sich als unmöglich oder ist mit einem unverhältnismäßigen Aufwand verbunden. Wir werden Sie zudem über diese Empfänger unterrichten, wenn Sie dies verlangen.
f) Sie haben das Recht, die personenbezogenen Daten, die Sie uns bereitgestellt haben, in einem strukturierten, gängigen und maschinenlesbaren Format zu erhalten, und können verlangen, dass wir diese Daten einem anderen Verantwortlichen ohne Behinderung übermitteln, soweit dies technisch möglich ist.
g) Soweit eine Datenverarbeitung auf Ihrer Einwilligung beruht, haben Sie das Recht, Ihre Einwilligung jederzeit zu widerrufen. Durch den Widerruf der Einwilligung wird die Rechtmäßigkeit der Datenverarbeitung, die bis zu Ihrem Widerruf erfolgt ist, nicht berührt.

(15) WIDERSPRUCHSRECHT: AUS GRÜNDEN, DIE SICH AUS IHRER BESONDEREN SITUATION ERGEBEN, KÖNNEN SIE JEDERZEIT DER VERARBEITUNG DER SIE BETREFFENDEN PERSONENBEZOGENEN DATEN WIDERSPRECHEN; dieses Widerspruchsrecht besteht in Bezug auf diejenige Datenverarbeitung, die auf Grundlage von Artikel 6 Absatz 1 Buchstabe f DSGVO zur Wahrung berechtigter Interessen unsererseits oder eines Dritten erfolgt, sofern nicht Ihre Interessen oder Grundrechte und Grundfreiheiten, die den Schutz personenbezogener Daten erfordern, überwiegen.

(16) FÜR DEN FALL, DASS WIR PERSONENBEZOGENE DATEN FÜR DIE DIREKTWERBUNG (Z.B. NEWSLETTER) VERARBEITEN, KÖNNEN SIE JEDERZEIT WIDERSPRUCH GEGEN DIE VERARBEITUNG DER SIE BETREFFENDEN PERSONENBEZOGENEN DATEN ZUM ZWECKE DERARTIGER WERBUNG EINLEGEN MIT DER FOLGE, DASS WIR IHRE DATEN FÜR DIESE ZWECKE NICHT MEHR VERARBEITEN WERDEN.

(17) Wenn Sie der Ansicht sind, dass die Verarbeitung Ihrer personenbezogenen Daten gegen die DSGVO verstößt, können Sie Beschwerde einlegen bei einer Aufsichtsbehörde, insbesondere in dem Mitgliedstaat Ihres Aufenthaltsorts, Ihres Arbeitsplatzes oder des Orts des mutmaßlichen Verstoßes. Das schließt anderweitige behördliche oder gerichtliche Rechtsbehelfe nicht aus.

(3) When you conclude a contract with us on Etsy, Etsy will transmit to us your Etsy username (unless you buy as “guest”), your name and the billing address as stored in your Etsy user account or otherwise provided when placing your order. If you have specified additional information with the order (e.g. a different shipping address or a phone number), they also will be transmitted to us.

(4) We process the data referred to in paragraph 3 electronically for the proper performance of the contract, in particular for shipping, invoicing, accounting, and processing of returns and complaints. This data processing is based on Article 6 par. 1 b GDPR. We store this data until all mutual claims arising from the respective contractual relationship with you have been completely settled and the commercial and fiscal retention periods to which we are subject have expired.

(5) To conclude a contract between you and us, it is necessary that we receive your name and a shipping address. The necessity of providing this data arises, among other things, from Etsy’s Terms and Conditions as well as from various statutory regulations (such as § 312i par. 1 and 3 BGB, § 14 par. 4 UStG). Without providing this data, you cannot conclude a contract with us.

(6) When we ship physical goods in order to perform a contract, we may transmit your name and shipping address to Deutsche Post (Deutsche Post AG, 53113 Bonn) or DHL (DHL Paket GmbH, 53113 Bonn) as the shipping service provider, for the purpose of delivering the shipment to you and, if necessary, for returns back to us, on the basis of Article 6 par. 1 b GDPR.

(7) To process your payment, the payment service provider chosen by you will collect and process, on your behalf, your name, your credit card or account number and/or further data necessary for the chosen payment method. The privacy policy of the payment service provider chosen by you shall apply, and, in case the payment is received by Etsy, Etsy’s privacy policy as well.

(8) Electronic marketplaces are obliged under the VAT Act (Section 22f UStG) to record the place of dispatch and destination of a delivery as well as the time and amount of turnover and to communicate this data to the tax authorities on request. Therefore, these details of a delivery that you have ordered may be transmitted to the tax authorities according to Article 6 par. 1 c GDPR.

(9) If you send us a message on Etsy via “Ask a question“, “Request a custom order” or a similar function on the Etsy platform, Etsy will transmit us your Etsy username, or, if you do not have an Etsy user name, other data identifying you as the sender, along with your message (legal basis: Article 6 par. 1 a GDPR). If you send us a message by e-mail, we will save your message along with the sender details (your name and e-mail address) in order to be able to answer it and also to respond to possible subsequent questions (legal basis: Article 6 (1) f GDPR). For the reception, storage and sending of e-mails, we use an e-mail provider who acts for us as a processor in accordance with Article 28 GDPR. We will erase the information collected from your message no later than six months after the last communication with you, subject to the following paragraph.

(10) If you send us a message with information legally relevant for the contractual relationship (e.g. a withdrawal or a complaint), the legal basis for the processing is Article 6 par. 1 b GDPR, regardless of how you transmitted your message to us. In such a case, we will erase the data related to your message as soon as all mutual claims arising from the contractual relationship have been completely settled and the commercial and fiscal retention periods have expired.

(11) You may find Social Media Buttons on the Etsy website; they can be recognized by the logos of the social media platforms (hereinafter “platforms”) (Facebook: blue “f”, Pinterest: red “p”, Twitter: blue bird silhouette). These are links to the respective platforms based in the United States (USA). Clicking on such a link calls the respective Platform’s website; at the same time, the IP address of your device and the address of the page where the link is placed (“Referrer”) will be transmitted to the Platform in the USA. However, we neither collect nor otherwise process any data related to the use of these social media buttons.

(12) Etsy uses various cookies. This does not exclude other administrative or judicial remedies.
