General Terms and Conditions and Customer Information

A. General Terms and Conditions

1) Scope of application
1.1 These terms and conditions of Annalena Wildemann (hereinafter referred to as "Seller") apply to all contracts that a consumer or entrepreneur (hereinafter referred to as "Customer") concludes with the Seller with regard to the goods and/or services presented by the Seller in his online shop. The inclusion of the customer's own terms and conditions is hereby objected to, unless otherwise agreed.

1.2 A consumer within the meaning of these General Terms and Conditions is any natural person who concludes a legal transaction for a purpose that can be attributed neither to their commercial nor their independent professional activity. An entrepreneur within the meaning of these General Terms and Conditions is any natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of his independent professional or commercial activity.

2) Conclusion of contract

2.1 The product descriptions contained in the Seller's online shop (Etsy) do not constitute binding offers on the part of the Seller, but serve to submit a binding offer by the Customer.

2.2 The customer can submit the offer via the online order form integrated in the seller's online shop. After entering his personal data, the customer submits a legally binding contract offer with regard to the goods and/or services contained in the shopping cart by clicking on the button that concludes the ordering process.

2.3 The Seller may accept the Customer's offer within three days - by sending the Customer a written order confirmation or an order confirmation in text form (e-mail), whereby the receipt of the order confirmation by the Customer is decisive in this respect, or - by delivering the ordered goods to the Customer, whereby the receipt of the goods by the Customer is decisive, or - by requesting payment from the customer after placing his order.

If several of the aforementioned alternatives exist, the contract is concluded at the time when one of the aforementioned alternatives first occurs. If the seller does not accept the customer's offer within the aforementioned period, this shall be deemed to be a rejection of the offer with the consequence that the customer is no longer bound by his declaration of intent.

2.4 The order processing and contact usually take place by e-mail and automated order processing. The customer must ensure that the e-mail address provided by him for order processing is correct, so that the e-mails sent by the seller can be received at this address. In particular, when using SPAM filters, the customer must ensure that all e-mails sent by the seller or third parties commissioned by the seller with the order processing can be delivered.

3) Return costs when exercising the right of withdrawal
If the customer has a right of withdrawal, the regular costs of the return will be imposed on him when exercising the right of withdrawal if the price of the item to be returned does not exceed an amount of 40 euros or if, in the case of a higher price of the item, the customer has not yet provided the consideration or a partial payment at the time of revocation, unless that the delivered goods do not correspond to those ordered. In all other cases, the seller shall bear the costs of the return.

4) Prices and terms of payment
4.1 The prices quoted by the Seller are final prices. VAT is not shown because the seller is a small entrepreneur within the meaning of § 19 (1) UStG.

4.2 In the case of deliveries to countries outside the European Union, further costs may be incurred in individual cases for which the Seller is not responsible and which are to be borne by the Customer. These include, for example, costs for the transfer of money by credit institutions (e.B. transfer fees, exchange rate fees) or import duties or taxes (e.B customs duties).

4.3 Various payment options are available to the customer, which are specified in the Seller's online shop.

4.4 If advance payment has been agreed, payment is due immediately after conclusion of the contract.

5) Delivery and shipping conditions
5.1 The delivery of goods takes place regularly on the dispatch route and to the delivery address specified by the customer. When processing the transaction, the delivery address specified in the seller's order processing is decisive.

5.2 If the transport company returns the shipped goods to the seller because delivery to the customer was not possible, the customer shall bear the costs for the unsuccessful shipment. This does not apply if the customer exercises his right of revocation by refusing acceptance, if he is not responsible for the circumstance that led to the impossibility of delivery or if he was temporarily prevented from accepting the offered service, unless the seller had announced the service to him a reasonable time in advance.

5.3 A self-collection is not offered by the seller.

6) Liability for defects
The statutory liability for defects shall apply.

7) Applicable law, place of jurisdiction, contract language
7.1 The law of the Federal Republic of Germany shall apply to all legal relationships between the parties to the exclusion of the laws on the international purchase of movable goods. In the case of consumers, this choice of law shall only apply to the extent that the protection granted is not withdrawn by mandatory provisions of the law of the state in which the consumer has his habitual residence.

7.2 The contract language is German.

These can be adapted by express request of the customer during the ordering process (individualization).

5.2 Acceptance by the Seller shall be made in accordance with Section 2.3 of the Seller's General Terms and Conditions (see above).

6) Information on the storage of the contract text When submitting an offer via the Seller's online order form, the contract text will be stored by the Seller and sent to the Customer in text form (e.B. e-mail, fax or letter) after sending his order together with the present GTC and customer information. In addition, the text of the contract is archived on the Seller's website and can be retrieved free of charge by the Customer via his password-protected customer account, stating the corresponding login data, provided that the Customer has created a customer account in the Seller's online shop before sending his order.

7) Information about the technical means to detect and correct input errors.
Before binding submission of the order via the seller's online order form, the customer can continuously correct his entries using the usual keyboard and mouse functions. In addition, all entries are displayed again in a confirmation window before the binding submission of the order and can also be corrected there using the usual keyboard and mouse functions.

Shipping

Shipping only! There is no shop.
A shipment can only take place after payment has been made!

Within Germany, most products are shipped by letter. Shipping costs of € 1.60 or € 2.75 are estimated. Individual items sent as letter mail are also offered with free shipping (only within Germany). The pure sending time of letters takes 1-2 working days (source: www.post.de).

Within the EU (with the exception of Germany) as well as to Switzerland, shipping is in most cases also carried out with Deutsche Post (3.70 € shipping costs). The pure shipping time varies from the respective country of the buyer. The delivery times stated for the respective articles may be extended by the corresponding period. Detailed information on shipping times can be found at Deutsche Post AG (www.post.de).

The delivery times stated in the respective product include the processing/production time as well as the aforementioned shipping times. The information on delivery times refers to working days.

The shipping of larger products (shipping costs DE = 4,30 €) is carried out by Hermes. If shipping to a Packstation is desired, you must choose the shipping method DHL (shipping costs 4.39 €).

Due to the strict customs conditions, I send goods to Switzerland up to the maximum total value of 40, - € per order.

HINTS:
1. All stated delivery times are valid in working days and taking into account normal domestic shipping times. Shipping times abroad may vary.

2. "Working days" refers to the regulation according to §3, abs. 2 Bundesurlaubsgesetz (BUrlG). Accordingly, working days are all calendar days that are not Sundays or public holidays. I only count Germany-wide public holidays as public holidays.

II) General information on data processing

1) Scope of application
This privacy policy informs you about how I collect, process and use your personal data in connection with an ordering process. Your use of the services of Etsy Ireland UC (hereinafter Etsy) is governed by Etsy's Privacy Policy.

2) Scope of processing of personal data
In principle, I only process personal data of my users to the extent necessary for my content and services. The processing of personal data of my users takes place regularly only with the consent of the user. An exception applies in those cases in which it is not possible to obtain prior consent for factual reasons and the processing of the data is permitted by law.

3) Legal basis for the processing of personal data

3) Data deletion and storage period
The personal data of the data subject will be deleted or blocked as soon as the purpose of storage no longer applies. Storage may also take place if this has been provided for by the European or national legislator in EU regulations, laws or other regulations to which the controller is subject. The data will also be blocked or deleted if a storage period prescribed by the aforementioned standards expires, unless there is a need for further storage of the data for the conclusion or fulfilment of a contract.

III) Data processing in the course of your order

1) Scope of processing of personal data
After each order you place, I receive and process your name, Etsy username and billing address as stored in your user account for the purposes of processing the order. If you provide further data in the context of your order (e.B. a different delivery address), I will also receive this data.

2) Purpose of data processing
I process this data electronically for the proper fulfilment of the contract, in particular for invoicing, the booking of payments and the dispatch of ordered goods to you. If necessary, I will pass on your name and address to a commissioned shipping company.

3) Duration of storage
I will keep your data stored until all mutual claims arising from your order have been fully fulfilled and the periods of commercial and tax retention obligations have expired.

4) Possibility of objection and removal
The user has the possibility to revoke his consent to the processing of personal data at any time. If the user contacts me by e-mail, he can object to the storage of his personal data at any time.

If the order process is not completed at the time of revocation, the order cannot be continued and completed. In such a case, the order as such will be considered as revocation. For the effects of the revocation of the order, the separate cancellation policy must be observed.

All personal data stored in the course of contacting us will be deleted in this case.

5) Disclosure of personal data to third parties
If you use the services of third parties, in particular payment services, for the payment of ordered goods (e.B. PayPal and credit card services), the respective data protection declaration of the respective providers (third parties) applies.
